(1) I gcás ina mbeidh cúis ag an Aire chun a chreidiúint, maidir le haon bhagairt, brú nó guais, nó teaglaim bagairtí, brúnna nó guaiseacha, gur de chineál í nó é a bhféadfadh— (a) éifeacht shuntasach a bheith aici nó aige ar Láithreán Eorpach, (b) éifeacht dhochrach a bheith aici nó aige ar shláine Láithreáin Eorpaigh, (c) gurb í nó é is cúis le meath ar ghnáthóga nádúrtha nó ar ghnáthóga speiceas nó le díshocrú na speiceas ar ina leith a bhféadfadh an Láithreán Eorpach a bheith ainmnithe nó a ainmníodh é de bhun na Treorach um Ghnáthóga, nó a aicmíodh é nó a bhféadfadh sé a bheith aicmithe, de bhun na Treorach um Éin, a mhéid a d’fhéadfadh sé gur dhíshocrú suntasach an díshocrú sin i ndáil le cuspóirí na Treorach um Éin nó na Treorach um Ghnáthóga, (d) gurb í nó é is cúis le truailliú nó meath ar ghnáthóga nó le haon díshocrú a dhéanfaidh difear d’éin de réir bhrí Airteagal 4 den Treoir um Éin, (e) éifeacht dhochrach a bheith aici nó aige ar stádas caomhantais na nithe seo a leanas— (i) speicis ainmhithe arna liostú in Iarscríbhinn IV(a) a ghabhann leis an Treoir um Ghnáthóga ina raon nádúrtha de bhun Airteagal 12 den Treoir um Ghnáthóga, (ii) speicis phlandaí arna liostú in Iarscríbhinn IV(b) a ghabhann leis an Treoir um Ghnáthóga de bhun Airteagal 13 den Treoir um Ghnáthóga, (iii) speicis de fauna agus flora fiáine arna liostú in Iarscríbhinn V a ghabhann leis an Treoir um Ghnáthóga de bhun Airteagal 14 den Treoir um Ghnáthóga, nó (iv) an speiceas éan dá dtagraítear in Airteagal 1 den Treoir um Éin, a n-uibheacha, a neadacha agus a ngnáthóga, nó (f) a bheith i gceist léi nó leis planda nó ainmhí a thabhairt isteach, a bhunú, a scaipeadh nó leanúint de bheith i láthair lena n-áirítear planda nó ainmhí dá dtagraítear sa Tríú Sceideal, ach gan a bheith teoranta dóibh, nó go bhféadfadh go bhforbróidh bagairt, brú nó guais, nó teaglaim bagairtí, brúnna nó guaiseacha, dá dtagraítear sa mhír seo de cheal bearta coisctheacha comhordaithe sprice lena cosc nó lena chosc, déanfaidh an tAire, i gcás ina measfaidh sé nó sí gur gá nó gur cuí chun cuspóirí na Treorach um Ghnáthóga nó na Treorach um Éin a chomhlíonadh, plean freagartha cuí do bhagairt a fhorbairt agus a chur i ngníomh chun an bhagairt, brú, guais, teaglaim bagairtí, brúnna nó guaiseacha, éifeacht dhochrach, truailliú, meath nó díshocrú a scor, a sheachaint, a fhreaschur, a laghdú, deireadh a chur léi nó leis, nó í nó é a chosc.
(1) Where the Minister has reason to believe that any threat, pressure or hazard, or combination of threats, pressures or hazards, is of a type that may— (a) have a significant effect on a European Site, (b) have an adverse effect on the integrity of a European Site, (c) cause the deterioration of natural habitats or the habitats of species or the disturbance of the species for which the European Site may be or has been designated pursuant to the Habitats Directive or has been classified, or may be classified, pursuant to the Birds Directive, insofar as such disturbance could be significant in relation to the objectives of the Birds Directive or the Habitats Directive, (d) cause pollution or deterioration of habitats or any disturbance affecting birds within the meaning of Article 4 of the Birds Directive, (e) have an adverse effect on the conservation status of— (i) animal species listed in Annex IV(a) to the Habitats Directive in their natural range pursuant to Article 12 of the Habitats Directive, (ii) plant species listed in Annex IV(b) to the Habitats Directive pursuant to Article 13 of the Habitats Directive, (iii) specimens of wild fauna and flora listed in Annex V to the Habitats Directive pursuant to Article 14 of the Habitats Directive, or (iv) the species of birds referred to in Article 1 of the Birds Directive, their eggs, nests and habitats, or (f) involve the introduction, establishment, dispersal or continuing presence of a plant or animal including, but not limited to, a plant or animal referred to in the Third Schedule, or that a threat, pressure or hazard, or a combination of threats, pressures or hazards, referred to in this paragraph may develop in the absence of coordinated targeted preventive measures to prevent it, the Minister shall, where he or she considers it necessary or appropriate for the purposes of meeting the objectives of the Habitats Directive or the Birds Directive, develop and implement an appropriate threat response plan to cease, avoid, reverse, reduce, eliminate or prevent the threat, pressure, hazard, combination of threats, pressures or hazards, adverse effect, pollution, deterioration or disturbance.
