(1) Where the Minister has reason to believe that any activity, either individually or in combination with other activities, plans or projects, is of a type that may— (a) have a significant effect on a European Site, (b) have an adverse effect on the integrity of a European Site, (c) cause the deterioration of natural habitats or the habitats of species or the disturbance of the species for which the European Site may be or has been designated pursuant to the Habitats Directive, or has been classified or may be classified, pursuant to the Birds Directive, insofar as such disturbance could be significant in relation to the objectives of the Birds Directive or the Habitats Directive, (d) cause pollution or deterioration of habitats or any disturbance affecting birds within the meaning of Article 4 of the Birds Directive, or (e) have an adverse effect on the conservation status of— (i) animal species listed in Annex IV(a) to the Habitats Directive in their natural range pursuant to Article 12 of the Habitats Directive, (ii) plant species listed in Annex IV(b) to the Habitats Directive pursuant to Article 13 of the Habitats Directive, or (iii) species of wild fauna and flora listed in Annex V to the Habitats Directive pursuant to Article 14 of the Habitats Directive, or (iv) birds referred to in Article 1 of the Birds Directive, the Minister may make an application under this Regulation to a court of competent jurisdiction for an order to require the taking of action or the refraining from taking action as the court considers necessary, for the purposes of ensuring compliance with the Habitats Directive or the Birds Directive, to cease, avoid, reverse, reduce or eliminate the adverse effect, pollution, deterioration or disturbance.

(3) (a) Where an authorised officer appointed under Regulation 4 or a member of An Garda Síochána finds on a European Site any animal or object referred to in paragraph (1)(b), or where a person has failed to comply with an instruction under paragraph (4)(a)(ii) or (iii) the authorised officer or member of An Garda Síochána may remove or cause to be removed, by whatever means he or she considers appropriate, from the land any such animal or object and bring or cause it to be brought to such place as he or she may determine for storage or impoundment as appropriate and, having done so, may, as he or she considers necessary or appropriate, transfer or cause it to be transferred from any place to any other place.

(1) Two or more persons claiming or being liable as partners and carrying on business within the jurisdiction may sue or be sued in the name of the respective firms, if any, of which such persons were partners at the time the cause of action accrued, and any party to an action may in such case apply by notice of motion to the Court for an order directing the persons who appear to be partners or the persons carrying on the business to furnish the names, descriptions and places of residence of the persons who were, at the time of the accrual of the cause of action, partners in any such firm in such manner and verified on oath or otherwise as the Court may direct.

(b) An animal or object may be detained in accordance with paragraph (a) by the authorised officer or member of the Garda Síochána— (i) for such period as he or she may consider necessary where he or she has reasonable cause to believe that the animal or object is likely to be used in committing an offence under these Regulations, (ii) for the purposes of— (I) further examination including forensic examination, (II) for use as evidence in proceedings, or (III) for establishing the ownership of the animal or object, or (iii) for any combination of the reasons referred to in (i) and (ii)of this subparagraph.

—(1) Where a coroner is informed that the dead body of a person is lying within his district and there is reasonable cause to suspect that the person has died a sudden death of which the cause is unknown, if the coroner is of opinion that a post-mortem examination may prove an inquest to be unnecessary, he may cause such an examination to be made and the result to be reported to him, and for the purposes of the examination the coroner and any person authorised by him to conduct the examination shall have the like powers, authorities and immunities as if the examination were an examination directed by the coroner at an inquest upon the body of the deceased.

—(1) The Minister may at any time cause an inquiry (in this Act referred to as a local inquiry) to be held in relation to the performance by an officer or a servant of a committee of agriculture of his duties as such officer or servant and for that purpose may appoint an officer of the Minister to hold such local inquiry.

(2) Where before the passing of this Act an advance was made by the late Congested Districts Board or by the Land Commission on the resale of land which was purchased by the said Board out of the funds at its disposal, the Land Commission may, whenever they think it expedient so to do, cause an account to be taken of the sum then outstanding and unpaid in respect of such advance and may charge such land with a purchase annuity calculated at the rate of three and one-quarter per cent per annum for the repayment of the sum so outstanding in lieu and satisfaction of the annuity theretofore payable in respect of such advance.

(4) Before altering or cancelling (otherwise than in accordance with an application in that behalf made under this section) the registration of any premises under this Act, the Minister shall give at least one fortnight's notice in writing of his intention so to cancel or alter such registration to the registered proprietor of such premises or his personal representative (if any) or its liquidator (as the case may be), and shall consider any representations made before the expiration of such notice by such registered proprietor or personal representative or liquidator (as the case may be), and may it he thinks fit cause an inquiry to be held in relation to the matter.

(4) Before cancelling (otherwise than in accordance with an application in that behalf made under this section) the registration of any person who is registered in a register kept in pursuance of this Part of this Act, the Minister shall give to sue, person or to his personal representative or liquidator (as the case may be) at least fourteen days notice in writing of his intention so to cancel such registration, and shall consider any representations made within fourteen days after the service of such notice by such person or personal representative or liquidator (as the case may be) and shall, if requested, cause an inquiry to be held in relation to the matter.

—(1) Where the Hospitals Commission, after consultation with the appropriate advisory committee, complain to the Minister that any person was refused admission as an intern patient to any hospital in relation to which a bureau has been established under this Act or that the treatment of any person admitted as an intern patient to any such hospital was unreasonably delayed, the Minister may, if in his discretion he so thinks proper, cause an inquiry to be held in relation to such complaint and may appoint a person to hold such inquiry.

(4) The Commissioners shall consider every observation sent to them by an objecting party within the time limited in that behalf by the next preceding sub-section of this section and may, if they so think proper in respect of any particular observation, cause an inspection to be made by one of their officers of the land owned or occupied by the objecting party who sent such observation and of the land specified in the originating representation to which such observation relates and of the existing watercourse or the site of the proposed new watercourse (as the case may be) mentioned in such representation.

—Where the Minister, having received a request in that behalf from a safety representative, a safety committee or a safety officer, considers it appropriate, he may cause an investigation to be carried out by an inspector as regards a danger or potential danger to the safety, health or welfare of persons employed in the relevant factory or specified premises which the safety representative, safety committee or safety officer believes to exist and specifies in the request, and when completed the Minister may, if he thinks fit, communicate the outcome of the investigation to the person or committee by whom the request was made.

(2) Accounts kept in pursuance of this section shall be submitted as soon as may he after the end of the financial year of An Foras or the subsidiary, as the case may be, to which they relate by An Foras to the Comptroller and Auditor General for audit and a copy of the income and expenditure account and of the balance sheet and of such other (if any) of its accounts as the Minister may direct and a copy of the Comptroller and Auditor General's report on the accounts shall be presented to the Minister as soon as may be and the Minister shall cause copies of each of the documents aforesaid to be laid before each House of the Oireachtas.

(2) A society which makes, or joins in making, an application for confirmation of an amalgamation or a transfer shall, within 7 days after the date of the application, cause to be published, in at least 2 daily newspapers published in the State and circulating in the areas in which the chief offices of the societies concerned in the proposal are situated, a notice giving particulars of the application and indicating that objections or representations relating to it may be made in writing to the Central Bank within such period (being not less than 21 days after the date of publication of the notice) as may be specified in the notice.

(1) Where the Minister has reason to believe that any threat, pressure or hazard, or combination of threats, pressures or hazards, is of a type that may— (a) have a significant effect on a European Site, (b) have an adverse effect on the integrity of a European Site, (c) cause the deterioration of natural habitats or the habitats of species or the disturbance of the species for which the European Site may be or has been designated pursuant to the Habitats Directive or has been classified, or may be classified, pursuant to the Birds Directive, insofar as such disturbance could be significant in relation to the objectives of the Birds Directive or the Habitats Directive, (d) cause pollution or deterioration of habitats or any disturbance affecting birds within the meaning of Article 4 of the Birds Directive, (e) have an adverse effect on the conservation status of— (i) animal species listed in Annex IV(a) to the Habitats Directive in their natural range pursuant to Article 12 of the Habitats Directive, (ii) plant species listed in Annex IV(b) to the Habitats Directive pursuant to Article 13 of the Habitats Directive, (iii) specimens of wild fauna and flora listed in Annex V to the Habitats Directive pursuant to Article 14 of the Habitats Directive, or (iv) the species of birds referred to in Article 1 of the Birds Directive, their eggs, nests and habitats, or (f) involve the introduction, establishment, dispersal or continuing presence of a plant or animal including, but not limited to, a plant or animal referred to in the Third Schedule, or that a threat, pressure or hazard, or a combination of threats, pressures or hazards, referred to in this paragraph may develop in the absence of coordinated targeted preventive measures to prevent it, the Minister shall, where he or she considers it necessary or appropriate for the purposes of meeting the objectives of the Habitats Directive or the Birds Directive, develop and implement an appropriate threat response plan to cease, avoid, reverse, reduce, eliminate or prevent the threat, pressure, hazard, combination of threats, pressures or hazards, adverse effect, pollution, deterioration or disturbance.

1. When the parties to a cause or matter are agreed as to the questions of fact to be decided between them, they may, after issue of the summons and before judgment, by consent and order of the Court, proceed to the trial of any such questions of fact without formal pleadings; and such questions may be stated for trial in an issue in the Form No. 17 in Appendix C, and such issue may be entered for trial and tried in the same manner as any issue joined in an ordinary action, and the proceedings shall be under the control and jurisdiction of the Court, in the same way as the proceedings in an action.

(8) If the Minister has reason to believe— (a) that an activity, plan or project that has been carried out within or outside a European Site pursuant to a consent has caused damage to that site or to species or habitat types for which the site was selected as a European Site, and (b) that such consent was obtained by a person or persons knowingly supplying false information or knowingly failing to divulge information or data that could be relevant to the determination by a public authority of whether, pursuant to Article 6(3) of the Habitats Directive, it could agree to the plan or project, having ascertained that the plan or project, individually or in combination with other plans or projects, would not have a significant effect on, or adversely affect the integrity of, a European Site, the Minister may make application to a court of competent jurisdiction for a restoration warrant, and the court, having investigated the matter, may give the Minister a restoration warrant, and, if it does so, it may also give an order quashing the consent referred to in subparagraph (b).

(1) (a) Where the Minister carries out or causes to be carried out an investigation which establishes that the reintroduction within the State or the establishment in any specified part thereof, of certain native species specified in Annex IV to the Habitats Directive— (i) would not have an adverse effect on the integrity of a European Site, (ii) would not cause deterioration of the natural habitats or species referred to in Article 2 of the Habitats Directive or Article 1 of the Birds Directive, (iii) would contribute effectively to re-establishing those species at a favourable conservation status, and (iv) would thereby contribute to their conservation, the Minister may, after consultation with such other Ministers of Government, local authorities or other bodies and individuals as he or she considers appropriate and having taken into account any other relevant considerations he or she considers appropriate, may authorise the reintroduction or establishment of any of the native species so specified.

(3) Whenever the Commission makes a recommendation to the Minister under subsection (1) of this section in relation to any goods on which a provisional duty has been paid and the Minister is satisfied that there has been dumping of those goods and that the dumping has caused or would, but for the provisional duty, have caused material injury to an industry in the State, the Government may, it they so think fit, by order under subsection (2) of this section impose an anti-dumping duty on those goods of such amount (not exceeding the margin of dumping in relation to the goods or the provisional duty on the goods, whichever is the lesser) as may be specified in the order and, upon the making of such an order in relation to goods, the payment of so much of the provisional duty chargeable in respect of the goods as is equal to the amount of the anti-dumping duty chargeable on the goods shall be deemed to have been a payment of the anti-dumping duty.

If it appear to the Court that there is in any cause or matter a question of law, which it would be convenient to have decided before any evidence is given or any question or issue of fact is tried, or before any reference is made to an arbitrator, the Court may make an order accordingly, and may direct such question of law to be raised for the opinion of the Court, either by special case or in such other manner as the Court may deem expedient, and all such further proceedings as the decision of such question of law may render unnecessary may thereupon be stayed.

Whenever an application shall be made before trial for an injunction or other order, and on the opening of such application, or at any time during the hearing thereof, it shall appear to the Court that the matter in controversy in the cause or matter is one which can be most conveniently dealt with by an early trial, without first going into the whole merits on affidavit or other evidence for the purposes of the application, the Court may make an order for such trial accordingly, and in the meantime make such order as the justice of the case may require.

At any stage in proceedings in prohibition, or in the nature of quo warranto, the Court on the application of any party or of its own motion may direct a plenary hearing with such directions as to pleadings, discovery, or otherwise as may be appropriate, and thereupon all further proceedings shall be conducted as in an action originated by plenary summons and the Court may give such judgement and make such order as if the trial were the hearing of an application to make absolute a conditional order to show cause.

(1) Where the Minister has reason to believe that any activity, either individually or in combination with other activities, plans or projects, is of a type that may— (a) have a significant effect on a European Site, (b) have an adverse effect on the integrity of a European Site, (c) cause the deterioration of natural habitats or the habitats of species or the disturbance of the species for which the European Site may be or has been designated pursuant to the Habitats Directive or has been classified pursuant to the Birds Directive, insofar as such disturbance could be significant in relation to the objectives of the Habitats Directive, (d) cause pollution or deterioration of habitats within the meaning of the second sentence of Article 4(4) of the Birds Directive, or (e) have an adverse effect on the conservation status of— (i) animal species listed in Annex IV(a) to the Habitats Directive in their natural range pursuant to Article 12 of the Habitats Directive, (ii) plant species listed in Annex IV(b) to the Habitats Directive pursuant to Article 13 of the Habitats Directive, (iii) species of wild fauna and flora listed in Annex V to the Habitats Directive pursuant to Article 14 of the Habitats Directive, (iv) naturally occurring birds in the wild state, the Minister shall, by notice, subject to paragraph (2), where he or she considers appropriate, direct that the activity shall not be carried out, caused or permitted to be carried out or continue to be carried out by any person in the European Site or part thereof or at any other specified land or may restrict or regulate the activity in the European Site or part thereof or at any other specified land, and each such notice shall be accompanied by a statement of the Minister’s reasons for making the decision.

(i) The Minister, the Garda Commissioner or delegate officer may dispose of, or cause to be disposed of, an object or animal removed and stored or impounded under this Regulation, if— (i) the owner of the animal or object or other person claiming that he or she can establish that he or she is, for a specified reason, otherwise entitled to its possession, fails to make application pursuant to subparagraph (a) within, in the case of an object, one month and in the case of an animal, ten days of the date on which a notice under subparagraph (a) was served on him or her, or (ii) the name and address of the owner of the animal or object has not been ascertained following reasonable enquiry within, in the case of an object, one month and in the case of an animal, ten days of the date on which the Minister or the Garda Commissioner or the delegate officer took or received custody of the animal or object (iii) the owner or person entitled to possession of the animal or object fails to take possession of it pursuant to subparagraph (c) at a time or times appointed by the Minister or the Garda Commissioner or the delegate officer in accordance with that subparagraph, the Minister, the Garda Commissioner or the delegate officer, as the case may be, having taken reasonable steps to facilitate its transfer, at the place where it is held, to such owner or person (iv) the owner or person entitled to possession of the animal or object refuses or fails to comply with subparagraph (k),or (v) the applicant fails to provide information requested under subparagraph (e)(i) within 14 days of the request.

[GA] (3) Where on an inspection of automatic or other technical equipment used in an intensive unit (whether the inspection is made in pursuance of the requirements of this section or otherwise) a defect in the equipment is discovered, the owner or the person who is for the time being in charge of the unit shall forthwith remedy, or cause to be so remedied, the defect, or, if this is impracticable, such owner or person shall forthwith take or cause to be so taken such measures as may be required to safeguard the welfare of animals kept in the unit, and in case such measures are taken, then until the defect is remedied such owner or person shall also ensure that such measures are maintained. [GA] (4) In any proceedings in which it is proved that an inspection referred to in subsection (2) or (3) of this section was carried out and that on such inspection either an animal to which this Act applies was found not to be in a state of well-being or a defect described in subsection (3) of this section was discovered, it shall be a defence for the defendant to show both that he was unaware that the inspection had been carried out and that in the circumstances of the case his being so unaware was not unreasonable. "( 4) (a) Beidh feidhm ag an mír seo maidir le limistéar a shonrófar i bhfógra a chuirfidh Coimisinéir an Gharda Síochána faoi deara a fhoilsiú i nuachtán amháin ar a laghad a léitear sa limistéar, nó maidir le bóthar poiblí a shonrófar i bhfógra a chuirfidh Coimisinéir an Gharda Síochána faoi deara a fhoilsiú i nuachtán amháin ar a laghad a léitear sa limistéar ina bhfuil an bóthar, agus beidh feidhm aici ar feadh cibé tréimhse a shonrófar san fhógra.
"(4) ( a ) This paragraph applies to an area specified in a notice caused by the Commissioner of the Garda Síochána to be published in at least one newspaper circulating in the area, or to a public road specified in a notice caused by the Commissioner of the Garda Síochána to be published in at least one newspaper circulating in the area in which the road is situated, and shall apply for such period as may be specified in the notice.

Where there is for the time being in force an order under section 19 of the Diseases of Animals Act, 1966 (No. 6 of 1966), declaring (in relation to brucellosis in cattle) an area to be either a clearance area or a disease-free area and there is in the area a herd in which there is for the time being an animal which an inspector appointed by the Minister believes to be or suspects of being infected with brucellosis in cattle, the Minister may in such manner as he considers appropriate cause the existence of such brucellosis in cattle to be brought to the notice of such occupiers of land as he considers appropriate.

(1) The returning officer shall cause a notice to be posted in a prominent place in each premises where members of the staff of An Chomhairle are employed inviting proposals for the selection of persons under this Order and the notice shall state the latest date for the receipt of proposals and the place where proposal forms may be obtained.

(5) Déanfaidh oifigeach údaraithe táirge díreach de phrátaí síl a iniúchadh mar bharr fáis agus mar thiúbair díobh, agus i gcás, ar iniúchadh den sórt sin a dhéanamh, go bhfaighfear amach go bhfuil an táirge galraithe nó foircthe le haon víreas nó orgánach a mheasfaidh oifigeach den sórt sin a bheith díobhálach, féadfaidh sé a cheangal ar an duine a bheidh, de thuras na huaire, i bhfeighil an táirge an táirge a dhiúscairt nó a dhíothú, nó a chur faoi deara an táirge a dhiúscairt nó a dhíothú, i cibé modh a ordóidh an t-oifigeach sin.
(5) The direct produce of imported seed potatoes shall be subject to inspection by an authorised officer both as a growing crop and as tubers therefrom, and in case on such an inspection the produce is found to be infected or infested with any virus or organism which such an officer considers to be harmful, he may require the person who for the time being is in charge of the produce to dispose of or destroy, or cause to be disposed of or destroyed, the produce in such manner as such officer shall direct.

(2) Féadfaidh oifigeach údaraithe, le linn dó cumhacht a bheith á feidhmiú aige a thugtar dó le mír (1) den Rialachán seo, a cheangal ar úinéir an áitribh, an vaigín iarnróid, na feithicle, na loinge, an árthaigh, an aerárthaigh nó an ní eile is cuí, nó ar an duine a bhfeictear don oifigeach gurb é atá ina fheighil nó ina bhun, cibé saoráidí réasúnacha agus cúnamh pearsanta a shonróidh an t-oifigeach a thabhairt, nó a chur faoi deara iad a thabhairt chun scrúdú, iniúchadh nó cuardach a dhéanamh nó sampla a thógáil faoi na Rialacháin seo, nó i ndáil leis na nithe sin.
(2) An authorised officer may in the course of exercising a power conferred on him by paragraph (1) of this Regulation require the owner, or the person who appears to the officer to be in apparent charge or control, of the relevant premises, railway wagon, vehicle, ship, vessel, aircraft or other thing to render, or cause to be rendered, for or in connection with the making of an examination, inspection or search or the taking of a sample under these Regulations, such reasonable facilities and personal assistance as the officer shall specify.
