Notes that the Foundation uses eight key performance indicators included in its performance monitoring system; notes in particular a visibly improved performance with regards to the uptake of the Foundation’s expertise in key Union-level policy documents, from 34,6 % in 2020 to 74 % in 2021, such as the proposal for a directive on strengthening the application of the principle of equal pay, the Council conclusions on telework, Commission reports on long-term care in the Union, digital labour platforms in the Union and the 2021 Employment and Social Developments in Europe review; notes, further, a strong performance with regard to the uptake of the Foundation’s knowledge in the media, with 1083 press articles in 2021 compared to 703 in 2020, and commends, in particular, the Foundation for its high-profile visibility in key European and international media outlets on the most pertinent topics such as the various impacts of the COVID-19 pandemic, telework, the right to disconnect and minimum wage issues; takes note of an increase in the Foundation’s engagement at policy-relevant events and meetings throughout 2021, from 202 contributions in 2020 to 360 contributions in 2021;

In light of the outcome of the exploratory talks that have been held between the Commission and Switzerland since March 2022, and building on the 2014 mandate for an institutional framework agreement as well as on earlier mandates for agreements on electricity, health, food safety and the participation of Switzerland in the European Union Agencies for the Space Programme and for Railways, the Commission recommended that negotiations be opened with Switzerland on a broad package which would encompass institutional provisions, to be included in existing and future agreements related to the internal market, that provide for dynamic alignment with the Union acquis, uniform interpretation and application of those agreements and the Union acquis, and dispute resolution, as well as State aid provisions to be included in existing and future agreements related to the internal market.

The Contracting Parties, in order to achieve the objective of arriving at as uniform an application and interpretation as possible of the provisions of this Agreement, shall keep under constant review the development of the case law of the Court of Justice of the European Communities, as well as the development of the case law of the competent courts of Iceland and Norway relating to these provisions and to those of similar surrender instruments.

9. Without prejudice to Article 17 of the Staff Regulations of officials of the European Communities, laid down in Regulation (EEC, Euratom, ECSC) No 259/68 [24], the Management Authority shall apply appropriate rules of professional secrecy or other equivalent duties of confidentiality to all its staff required to work with VIS data.

In compliance with a decision of 27 February, 1980 of the Court of Justice of the European Communities these Regulations provide, with effect from 1 January, 1981, facilities for deferment of payment of excise duty on imported beer, spirits, and made wine equivalent to the facilities for domestic producers of these products.
