Ní rachaidh an Coinbhinsiún seo chun dochair do Bhallstáit an Chomhphobail Eorpaigh Rialachán (CE) Uimh. 44/2001 ón gComhairle ar dhlínse agus ar aithint agus ar fhorghníomhú breithiúnas in ábhair shibhialta agus tráchtála, chomh maith le haon leasuithe air sin, an Coinbhinsiún ar Dhlínse agus ar Fhorghníomhú Breithiúnas in Ábhair Shibhialta agus Tráchtála, a síníodh sa Bhruiséil an 27 Meán Fómhair 1968, ná an Prótacal ar léiriú an Choinbhinsiúin ag Cúirt Bhreithiúnais na gComhphobal Eorpach, a síníodh i Lucsamburg an 3 Meitheamh 1971, arna leasú ag na Coinbhinsiúin Aontachais leis an gCoinbhinsiún sin agus leis an bPrótacal ag na Stáit a aontaíonn do na Comhphobail Eorpacha, agus thairis sin, an Comhaontú idir an Comhphobal Eorpach agus Ríocht na Danmhairge ar dhlínse agus ar aithint agus ar fhorghníomhú breithiúnas in ábhair shibhialta agus tráchtála, a síníodh sa Bhruiséil an 19 Deireadh Fómhair 2005, a chur chun feidhme.
This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.
