If the country concerned is a Party to the WTO Agreement on Government Procurement or has concluded a trade agreement with the EU that includes provisions on public procurement, the Commission shall follow the consultation mechanisms and/or dispute settlement procedures set out in that agreement when the restrictive practices relate to procurement covered by market access commitments undertaken by the country concerned towards the Union.

Consequently, measures adopted under this Regulation can only apply to economic operators, goods or services from third countries that are not parties to the plurilateral WTO Agreement on Government Procurement or to bilateral or multilateral trade agreements concluded with the Union that include commitments on access to public procurement or concession markets, or to economic operators, goods or services from countries that are parties to such agreements but only with respect to public procurement procedures for goods, services or concessions that are not covered by those agreements.

the exclusion of goods, services or suppliers of goods or services of the third country concerned from public procurement or the exclusion from public procurement of tenders the total value of which is made up of more than 50 % of goods or services originating in the third country concerned, unless a lower percentage is necessary in light of the exceptional circumstances of the case and provided that the remaining percentage of goods or services is not covered by Union commitments under the Agreement on Government Procurement (GPA) concluded within the World Trade Organization or another agreement on public procurement concluded between the Union and a third country other than the third country concerned; or

(3) (a) The terms and conditions applying to the provision of free postage to candidates pursuant to all or any of the provisions specified in subparagraphs (i) to (iv) of the definition of “relevant postal service provider” in subsection (1) shall be agreed by the Minister for Public Expenditure and Reform and the relevant postal service provider concerned, after consultation with the Minister for the Environment, Community and Local Government and, where appropriate, the Minister for Defence.

(f) Government guidelines on public procurement shall not apply to an agreement made under paragraph (a)(ii) or (iii), except in the case of an agreement which is subject to the requirements of Council Directive No. 93/37/EEC(1) on the co-ordination of procedures relating to the award of Public Works Contracts and any directive amending or replacing that directive.
(i) Ní bheidh feidhm ag treoirlínte Rialtais ar sholáthar poiblí maidir le comhaontú a dhéanfar faoi mhír (a) nó (b) ach amháin i gcás comhaontaithe a bheidh faoi réir cheanglais Threoir Uimh. 93/37/CEE ón gComhairle ar chomhordú nósanna imeachta a bhaineann le Conarthaí Oibreacha Poiblí a dhámhachtain agus aon treorach lena leasaítear an treoir sin nó a chuirtear ina hionad.
