During the two-year period between 2020 and 2022, the Working Party on Transport of Dangerous Goods (WP.15) and the ADN Administrative Committee adopted amendments to the Annexes to the ADR and to the Regulations annexed to the ADN, respectively, which were notified to the ADR Contracting Parties on 6 July 2022 and to the ADN Contracting Parties on 1 July 2022.

The amendments adopted during the 2018–2020 biennium by WP.15 and the ADN Administrative Committee on the transport of dangerous goods by road and inland waterways were notified to the ADR and ADN Contracting Parties on 1 July 2020.

The position to be taken on the Union’s behalf as regards the amendments to the Annexes to the ADR adopted by the Working Party on the Transport of Dangerous Goods (WP.15) and the amendments to the Regulations annexed to the ADN adopted by the ADN Administrative Committee, is to support the following amendments:

Pursuant to Article 20 of the ADN, any draft amendment to the Regulations annexed to the ADN is deemed to be accepted unless at least one third of the Contracting Parties, or five of them if one third exceeds that figure, objects to those amendments within three months from the date on which the Secretary-General circulated them.

The Regulations annexed to the ADN, as applicable with effect from 1 January 2023, as well as Article 3, points (f) and (h) and Article 8(1) and (3) of the ADN, it being understood that “contracting party” is replaced by “Member State” as appropriate.’.

Article 4 of Directive 2008/68/EC provides that the transport of dangerous goods between Member States and third countries shall be authorised in so far as it complies with the requirements of the ADR, the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) set out in Appendix C to the Convention concerning International Carriage by Rail (COTIF) and the ADN, unless otherwise indicated in the Annexes to that Directive.

Directive 2008/68/EC of the European Parliament and of the Council of 24 September 2008 extends to national transport the uniform rules contained in the European Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road (ADR), the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) and the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN).
Caibidil 5.4 de Chuid 5 d’Iarscríbhinn A a ghabhann leis an gComhaontú Eorpach maidir le hIompar Idirnáisiúnta Earraí Contúirteacha de Bhóthar (ADR) a cuireadh i gcrích sa Ghinéiv an 30 Meán Fómhair 1957, dá dtagraítear i Roinn I.1 d’Iarscríbhinn I a ghabhann le Treoir 2008/68/CE ó Pharlaimint na hEorpa agus ón gComhairle; Caibidil 5.4 de Chuid 5 de na Rialacháin maidir le hIompar Idirnáisiúnta Earraí Contúirteacha d’Iarnród (RID), atá mar Aguisín C a ghabhann le COTIF a cuireadh i gcrích ag Vilnias an 3 Meitheamh 1999, dá dtagraítear i Roinn II.1 d’Iarscríbhinn II a ghabhann leis an Treoir sin; agus Caibidil 5.4 de Pháirt 5 de na Rialacháin atá i gceangal leis an gComhaontú Eorpach maidir le hIompar Idirnáisiúnta Earraí Contúirteacha d’Uiscebhealaí Intíre (ADN), a cuireadh i gcrích sa Ghinéiv an 26 Bealtaine 2000, dá dtagraítear i Roinn III.1 d’Iarscríbhinn III a ghabhann leis an Treoir sin;
Chapter 5.4 of Part 5 of Annex A to the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), concluded at Geneva on 30 September 1957, as referred to in Section I.1 of Annex I to Directive 2008/68/EC of the European Parliament and of the Council; Chapter 5.4 of Part 5 of the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID), appearing as Appendix C to COTIF concluded at Vilnius on 3 June 1999, as referred to in Section II.1 of Annex II to that Directive; and Chapter 5.4 of Part 5 of the Regulations annexed to the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN), concluded at Geneva on 26 May 2000, as referred to in Section III.1 of Annex III to that Directive;
