De réir an pháirtí, is beart cur chun feidhme den Chomhaontú Frithdhumpála é an bun-Rialachán agus ó tharla go gceadaíonn Airteagal 5(10) den Chomhaontú Frithdhumpála go dtabharfaí imscrúduithe i gcrích laistigh den tréimhse uasta 18 mí, bheadh an tAontas Eorpach i dteideal maolú ar na sprioc-amanna imscrúdaithe agus na teorainneacha ama a luaitear sa Chomhaontú Frithdhumpála a chur i bhfeidhm.

According to the party, the basic Regulation is an implementing measure of the ADA and since Article 5(10) of the ADA allows for investigations to be concluded within the maximum time-frame of 18 months, the European Union would be entitled to derogate to the investigation deadlines and apply the time limits mentioned in the ADA.

De réir ZTT, ní raibh aon ní sa Chomhaontú Frithdhumpála a cheadaigh maolú ón riail ghinearálta sin, agus ní raibh coincheap an tsaofa shuntasaigh ann sa Chomhaontú Frithdhumpála.

There was, according to ZTT, nothing in the ADA which allowed to derogate from that general rule, and the notion of significant distortions did not exist in the ADA.

Luaigh Chengxi Shipyard freisin nach bhfuil coinníollacha Airteagal 2 ADA, go háirithe Airteagal 2.2.1 ADA, comhoiriúnach le coinníollacha Airteagal 2(6a) den bhun-Rialachán.

Maidir leis an maíomh nach bhfuil an coincheap ‘saobhadh suntasach’ a áirítear in Airteagal 2(6a) den bhun-Rialachán le feiceáil in aon riail de Chomhaontú Frithdhumpála na hEagraíochta Domhanda Trádála ná de Chomhaontú Ginearálta 1994 um Tharaifí agus Trádáil, mheabhraigh an Coimisiún nach gá don dlí náisiúnta úsáid a bhaint as na téarmaí ceannann céanna agus a úsáidtear sna Comhaontuithe cumhdaithe chun bheith i gcomhréir leis na Comhaontuithe sin, agus go measann sé go bhfuil Airteagal 2(6a) i gcomhréir go hiomlán le rialacha ábhartha an Chomhaontaithe Frithdhumpála (agus, go háirithe, na féidearthachtaí chun gnáthluach a ríomh dá bhforáiltear in Airteagal 2.2 den Chomhaontú Frithdhumpála).

Concerning the claim that the concept of ‘significant distortions’ included in Article 2(6a) of the basic Regulation does not appear in any rule of the WTO ADA or the GATT 1994, the Commission recalled that domestic law does not need to use the exact same terms as the covered Agreements in order to be compliant with those Agreements, and that it considers Article 2(6a) to be fully compliant with the relevant rules of the ADA (and, in particular, the possibilities to construct normal value provided in Article 2.2 ADA).

  8. #2300168

Maidir leis an éileamh nach bhfuil an coincheap “saobhadh suntasach” a áirítear in Airteagal 2(6a) den bhun-Rialachán le feiceáil in aon riail de Chomhaontú Frithdhumpála na hEagraíochta Domhanda Trádála ná de Chomhaontú Ginearálta 2.2 um Tharaifí agus Trádáil, mheabhraigh an Coimisiún nach gá don dlí náisiúnta úsáid a bhaint as na téarmaí ceannann céanna agus a úsáidtear sna Comhaontuithe cumhdaithe chun bheith i gcomhréir leis na Comhaontuithe sin, agus go measann sé go bhfuil Airteagal 2(6a) i gcomhréir go hiomlán le rialacha ábhartha an Chomhaontaithe Frithdhumpála (agus, go háirithe, na féidearthachtaí chun gnáthluach a ríomh dá bhforáiltear in Airteagal 2.2 den Chomhaontú Frithdhumpála).

Moreover, concerning the claim that the concept of significant distortions included in Article 2(6a) of the Basic Regulation is not listed among the situations in which it is permissible to construct the normal value pursuant to Article 2.2 ADA, the Commission recalled that domestic law does not need to use the exact same terms as the covered Agreements in order to be compliant with those Agreements, and that it considers Article 2(6a) to be fully compliant with the relevant rules of the ADA (and, in particular, the possibilities to construct normal value provided in Article 2.2 ADA).

ADA, mar aon leis na torthaí in DS473 agus DS494, d’athdhearbhaigh an Coimisiún an tuairim a chur sé in iúl in aithrisí (72) agus (73) den Rialachán sealadach go bhfuil Airteagal 2(6a) den bhun-Rialachán go hiomlán i gcomhréir le hoibleagáidí an Aontais faoi dhlí EDT.

Thairis sin, maidir leis an maíomh nach liostaítear coincheap an tsaofa shuntasaigh a chuimsítear in Airteagal 2(6a) den bun-Rialachán i measc na gcásanna inar ceadmhach an gnáthluach a ríomh de bhun Airteagal 2.2. ADA, mheabhraigh an Coimisiún nach gá don dlí náisiúnta na téarmaí ceannann céanna leis na téarmaí atá sna Comhaontuithe cumhdaithe a úsáid chun bheith i gcomhréir leis na Comhaontuithe sin, agus go measann sé go gcomhlíonann Airteagal 2(6a) rialacha ábhartha ADA go hiomlán (agus go háirithe na féidearthachtaí a fhoráiltear in Airteagal 2.2 ADA maidir leis an gnáthluach a ríomh).

Ar an dara dul síos, mhaígh CISA nach sainaithnítear i gComhaontú Frithdhumpála EDT (“ADA”) coincheap an tsaofa shuntasaigh in Airteagal 2.2 ADA.

  17. #2816220

Ar an gcéad dul síos, measann an Coimisiún go bhfuil coincheap “an tsaofa shuntasaigh” i gcomhréir le ADA.

First, the Commission considers concept of 'significant distortions’ to be compatible with the ADA.

Commission Implementing Regulation (EU) 2023/968 of 16 May 2023 imposing a definitive anti-dumping duty on imports of certain heavy plate of non-alloy or other alloy steel originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council

D’áitigh CCCMC thairis sin gur cosúil go bhfuil Airteagal 2(6a) den bhun-Rialachán ar neamhréir le Comhaontú Frithdhumpála na hEagraíochta Domhanda Trádála (‘ADA’), toisc (i) nach bhfuil tagairt don choincheap a bhaineann le ‘saobhadh suntasach’ in Airteagal 2.2 de ADA; (ii) go gceadaítear le hAirteagal 2(6a) úsáid sonraí ó thír ionadaíoch iomchuí nó praghsanna idirnáisiúnta chun gnáthluach a chumadh; agus (iii) is cosúil go sáraíonn Airteagal 2(6a) Airteagal 2.2.1.1. den Chomhaontú Frithdhumpála.

The CCCMC argued further that Article 2(6a) of the basic Regulation appears to be incompatible with the World Trade Organisation Anti-Dumping Agreement (‘ADA’), as (i) there is no reference to the concept of ‘significant distortions’ in Article 2.2 of the ADA; (ii) Article 2(6a) allows the use of data from an appropriate representative country or international prices to construct normal value; and (iii) Article 2(6a) appears to violate Article 2.2.1.1. of the ADA.

  20. #3404697

D’áitigh Anhui RunYue nach n-aithnítear in Airteagal 2.2 de Chomhaontú Frithdhumpála EDT (‘ADA’) coincheap an tsaofa shuntasaigh, agus fiú dá dtiocfadh an coincheap faoi raon Airteagal 2.2 den Chomhaontú Frithdhumpála, ní mór ríomh an ghnáthluacha ríofa ag an Aontas a bheith i gcomhréir le hAirteagal 2.2.1.1 den Chomhaontú Frithdhumpála agus le léirmhíniú an Chomhlachta Achomhairc air, dá bhforáiltear in DS 473.

Anhui RunYue argued that Article 2.2 of the WTO Anti-dumping Agreement (‘ADA’) does not recognise the concept of significant distortions, and even if the concept was to fall within the ambit of Article 2.2 ADA, the EU’s calculation of the constructed normal value needs to be in conformity with Article 2.2.1.1 ADA and with the Appellate Body’s interpretation thereof, as provided in DS 473.

Commission Implementing Regulation (EU) 2024/1064 of 9 April 2024 imposing a provisional anti-dumping duty on imports of certain alkyl phosphate esters originating in the People’s Republic of China

  21. #3404712

Ar an gcéad dul síos, maidir leis an maíomh nach gcomhfhreagraíonn coincheap an tsaofa shuntasaigh de bhun Airteagal 2(6a) den bhun-Rialachán d’aon choincheap comhchosúil faoi Airteagal 2.2 den Chomhaontú Frithdhumpála, measann an Coimisiún go bhfuil Airteagal 2(6a) den bhun-Rialachán i gcomhréir go hiomlán le rialacha ábhartha an Chomhaontaithe Frithdhumpála, lena n-áirítear na féidearthachtaí chun gnáthluach a ríomh dá bhforáiltear in Airteagal 2.2 den Chomhaontú Frithdhumpála.

First, concerning the claim that the concept of significant distortions pursuant to Article 2(6a) of the basic Regulation does not correspond to any similar concept under Article 2.2 ADA, the Commission considers Article 2(6a) of the basic Regulation to be fully compliant with the relevant rules of the ADA, including the possibilities to construct normal value provided in Article 2.2 ADA.

    (120) Ar an gcéad dul síos, d’áitigh CCCMC agus Xinjiang XLX go bhfuil Airteagal 2(6a) den bhun-Rialachán ar neamhréir le dlí EDT agus ar neamhréir go sonrach le hAirteagal 2.2 den Chomhaontú Frithdhumpála, agus rinne siad cáineadh ar an gCoimisiún toisc nár mhínigh sé an chaoi a bhfuil a chleachtas maidir le cur i bhfeidhm Airteagal 2(6a) den bhun-Rialachán i gcomhréir leis an réasúnaíocht a leagtar amach i gcinntí comhsheasmhacha éagsúla ó Bhuanchomhlacht Achomhairc EDT inar suíodh go raibh cleachtais chomhchosúla an Aontais agus comhaltaí eile maidir leis an ngnáthluach a ríomh ar neamhréir le hoibleagáidí Airteagal 2.2 den Chomhaontú Frithdhumpála.

    (120) First, CCCMC and Xinjiang XLX insisted that Article 2(6a) of the basic Regulation is inconsistent with WTO law and inconsistent specifically with Article 2.2 ADA and they criticized the Commission for not explaining how its practice in applying Article 2(6a) of the basic Regulation accords with the reasoning set out in several consistent WTO Appellate Body determinations that have found similar EU and other members’ practices in constructing normal value to be inconsistent with the obligations of Article 2.2 ADA. Moreover, CCCMC and Xinjiang XLX requested the Commission not to merely dismiss their argument by claiming that the WTO allows the use of data from a third country, but instead to explain how the Commision carried out the adaptation required by Article 2.2 ADA to arrive at the cost of production ‘in the country of origin’.

Commission Implementing Regulation (EU) 2023/1776 of 14 September 2023 imposing a definitive anti-dumping duty on imports of melamine originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council

  23. #2018725

Sa chéad dul síos, mhaígh CCCMC nach sainaithnítear i gComhaontú Frithdhumpála EDT (“ADA”) coincheap an tsaofa shuntasaigh in Airteagal 2.2 ADA, airteagal faoina gceadaítear ríomh an ghnáthluacha sa chás nach bhfuil aon díolachán i ngnáthchúrsa na trádála agus sa chás sin amháin.

First, CCCMC claimed that the WTO Anti-Dumping Agreement (‘ADA’) does not recognise the concept of significant distortions in Article 2.2 ADA, which only allows the construction of the normal value if there are no sales in the ordinary course of trade.

Thíolaic siad nach gceadaítear leis an modheolaíocht a leagtar síos in Airteagal 2 den ADA faisnéis a úsáid seachas an fhaisnéis sa tír is onnmhaireoir chun an gnáthluach a shuí agus nach bhfuil aon ní sa ADA a cheadódh neamhaird a dhéanamh ar chostais agus ar phraghsanna an táirgeora onnmhairiúcháin ná ar chostais agus ar phraghsanna atá sa tír is onnmhaireoir ná praghsanna nó tagarmharcanna a líomhnaítear a bheith saofa a chur ina n-ionad i dtír ionadaíoch iomchuí, mar a thugtar air.

They submitted that the methodology stipulated in Article 2 of the ADA does not permit the use of information other than that in the exporting country in order to establish the normal value and that there is nothing in the ADA which would allow disregarding the costs and prices of the exporting producer or those existing in the exporting country, and replace them instead with allegedly undistorted prices or benchmarks in a so-called appropriate representative country.

Dúirt Rialtas Ríocht na hAraibe Sádaí toisc nár tionscnaíodh an t-imscrúdú de réir fhorálacha Airteagal 5 den Chomhaontú Frithdhumpála, nár comhlíonadh an chéad choinníoll maidir le dleacht frithdhumpála a fhorchur faoi Airteagal 7.1(i) den Chomhaontú Frithdhumpála agus nár cheart aon dleacht frithdhumpála a fhorchur, dá bhrí sin, ar allmhairí MEG de thionscnamh Ríocht na hAraibe Sádaí.

The GKSA added that as the investigation was not initiated in accordance with the provisions of Article 5 of the ADA, the first condition for the imposition of an anti-dumping duty under Article 7.1(i) of the ADA was not satisfied and no anti-dumping duty should thus had been imposed on imports of MEG originating in the KSA.

  26. #2152371

De réir SABIC, chinn an Painéal cé nár fhorchuir Airteagal 2.3 den Chomhaontú Frithdhumpála, airteagal ina bhfuil athrá ar Airteagal 2(9) den bhun-Rialachán, ceanglas chun cinneadh a dhéanamh maidir le hiontaofacht an phraghais onnmhairiúcháin, níor ceadaíodh le hAirteagal 2.3 den Chomhaontú Frithdhumpála do na húdaráis imscrúdúcháin an praghas onnmhairiúcháin a ríomh aon uair a bhí comhlachas ann.

According to SABIC, the Panel found that while Article 2.3 of ADA, which mirrors Article 2(9) of the basic Regulation, did not impose a requirement to make a determination as to the reliability of the export price, Article 2.3 of ADA did not allow investigating authorities to construct the export price whenever there was an association.

Ina mbarúlacha tar éis an nochta deiridh, mhaígh GKSA nach raibh an anailís ar mhéid na n-allmhairí bunaithe ar scrúdú oibiachtúil ar an bhfianaise dhearfach mar a éilítear faoi Airteagal 3.1 de chuid ADA, agus nach raibh míniú leormhaith nó réasúnta chun tacú leis an toradh gurbh ann do mhéadú suntasach ar allmhairí MEG ón Araib Shádach nó ón Araib Shádach agus ó SAM ar bhonn carnach de réir bhrí Airteagal 3.2 ADA.

In their comments following final disclosure, the GKSA claimed that the analysis of import volume was not based on an objective examination of positive evidence as required under Article 3.1 of ADA nor was there a reasoned and adequate explanation in support of the finding that there was a significant increase in MEG imports from the KSA or from the KSA and the US on a cumulative basis within the meaning of Article 3.2 of ADA.

Commission Implementing Regulation (EU) 2021/1976 of 12 November 2021 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of mono ethylene glycol originating in the United States of America and the Kingdom of Saudi Arabia

  28. #2154707

Mheabhraigh an Coimisiún, mar a thug an gearánach dá aire cheana ina fhreagra ar bharúlacha Rialtas na Síne agus CCCME, gurb é Airteagal 5.2 an caighdeán dlí is infheidhme maidir le himscrúdú frithdhumpála a thionscnamh agus gurb é Airteagal 3.4 den ADA caighdeán athbhreithnithe an údaráis imscrúdaithe, an Coimisiún sa chás seo.

The Commission recalls, as the complainant already noted in its response to the comments of the GOC and the CCCME, that the applicable legal standard for the initiation of an anti-dumping investigation is Article 5.2 of the ADA, whereas Article 3.4 of the ADA constitutes the standard for the review by the investigating authority, in this case the Commission.

Commission Implementing Regulation (EU) 2021/2011 of 17 November 2021 imposing a definitive anti-dumping duty on imports of optical fibre cables originating in the People’s Republic of China

  29. #2154709

De bhrí, mar a thug CCCME le fios, go ndéantar tagairt in Airteagal 5.2 den ADA d’Airteagal 3.4 den ADA, agus go ndéantar tagairt in Airteagal 5(2) den bhun-Rialachán d’Airteagal 3(5) den bhun-Rialachán, níl sa tagairt sin ach tagairt léiritheach sa dá chás (‘amhail [tosca agus innéacsanna] a liostaítear i míreanna 2 agus 4 d’Airteagal 3’ agus ‘amhail[tosca agus innéacsanna] a liostaítear in Airteagal 3(3) agus (5)’).

Whereas, as the CCCME noted, Article 5.2. of the ADA makes reference to Article 3.4 of the ADA, and that Article 5(2) of the basic Regulation makes reference to Article 3(5) of the basic Regulation, such a reference is merely illustrative in both instances (‘such as [factors and indices] listed in paragraphs 2 and 4 of Article 3’ and ‘such as [factors and indices] listed in Article 3(3) and (5)’).

Ar an gcéad dul síos, chuir CCCME isteach nach n-aithnítear in Airteagal 2.2 de Chomhaontú Frithdhumpála na hEagraíochta Domhanda Trádála coincheap an tsaofa shuntasaigh, agus nach bhfuil aon airteagal sa Chomhaontú Frithdhumpála lena gceadaítear sonraí ó thríú tír nach féidir a léiriú leo praghsanna nó leibhéal costais na tíre is onnmhaireoir atá le húsáid chun an gnáthluach a chinneadh.

Firstly, CCCME submitted that Article 2.2 of the WTO Antidumping Agreement (ADA) does not recognize the concept of significant distortions, and that there is no article in the ADA allowing data from a third country which cannot reflect the prices or cost level of the exporting country to be used for determining the normal value.

  31. #2155332

I ndáil leis an méid sin, rinne ZTT tagairt don sainmhíniú ar ghnáthluach in Airteagal 2.1 den Chomhaontú Frithdhumpála agus do na himthosca eisceachtúla a thuairiscítear in Airteagal 2.2 den Chomhaontú Frithdhumpála ina bhféadfaí an gnáthluach a bhunú ar bhonn praghas inchomparáide táirge chomhchosúil nuair a onnmhairítear é go tríú tír iomchuí ar choinníoll go bhfuil an praghas sin ionadaíoch, nó ar bhonn costas táirgthe sa tír thionscnaimh móide méid réasúnta do chostais SGA agus do bhrabúis.

In that respect, ZTT referred to the definition of normal value in Article 2.1 of the ADA and the exceptional circumstances described in article 2.2 of the ADA in which the normal value could be established on the basis of a comparable price of the like product when exported to an appropriate third country provided that this price is representative, or on the basis of the cost of production in the country of origin plus a reasonable amount for SGA and for profits.

  32. #2155400

Ar an dara dul síos, d'áitigh Rialtas na Síne nach raibh sé comhsheasmhach leis an gComhaontú Frithdhumpála an gnáthluach a ríomh i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán, agus go háirithe le hAirteagal 2.2 den Chomhaontú Frithdhumpála, ina soláthraítear liosta uileghabhálach de chásanna inar féidir an gnáthluach a ríomh agus gan ‘saobhadh suntasach’ a bheith san áireamh iontu sna cásanna sin.

Second, the GOC argued that constructing normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the ADA, in particular with Article 2.2. of the ADA which provides an exhaustive list of situations where the normal value can be constructed, ‘significant distortions’ not being listed among such situations.

  33. #2179726

Ar an dara dul síos, d’áitigh Rialtas na Síne go bhfuil ríomh an ghnáthluacha i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán ar neamhréir le ADA, go háirithe le hAirteagal 2.2. Second, the GOC argued that constructing normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the ADA, in particular with Article 2.2. of the ADA which provides and exhaustive list of situations where the normal value can be constructed, the “significant distortions” not being listed among such situations.

  34. #2300145

Ar an dara dul síos, d’áitigh Rialtas na Síne go bhfuil ríomh an ghnáthluacha i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán ar neamhréir le ADA, go háirithe le hAirteagal 2.2. ADA lena soláthraítear liosta uileghabhálach de chásanna inar féidir an gnáthluach a ríomh, ach gan “saobhadh suntasach” a bheith liostaithe i measc na gcásanna sin.

Second, the GOC and the CCCME argued that constructing normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the ADA, in particular with Article 2.2. of the ADA which provides an exhaustive list of situations where the normal value can be constructed, with “significant distortions” not being listed among such situations.

  35. #2339430

Ar an dara dul síos, d’áitigh Rialtas na Síne go bhfuil ríomh an ghnáthluacha i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán ar neamhréir leis an gComhaontú Frithdhumpála (“ADA”) de chuid EDT, go háirithe le hAirteagal 2.2.

Second, the GOC argued that constructing normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the WTO Anti-Dumping Agreement (‘ADA’), in particular with Article 2.2 of the ADA which provides an exhaustive list of situations where the normal value can be constructed, with ‘significant distortions’ not being listed.

Commission Implementing Regulation (EU) 2022/468 of 23 March 2022 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of calcium silicon originating in the People’s Republic of China

  36. #2339487

Ar an tríú dul síos, d’áitigh Shenghua gur le reachtaíocht an Aontais tugadh isteach coincheap nach ann dó in ADA a mhéid a fhoráiltear inti maidir leis an ngnáthluach a ríomh má shuitear gurb ann do shaobhadh suntasach, d’ainneoin nach dtugtar sainordú le hAirteagal 2.2 ADA an gnáthluach a ríomh ach amháin i gcás nach ann d’aon díolachán le linn an ghnáthchúrsa trádála.

Third, Shenghua submitted that the EU legislation introduced a concept that does not exist in the ADA, insofar as it provides for constructing normal value if existence of significant distortions is established, while Article 2.2 of the ADA mandates the construction of normal value only if there are no sale in the ordinary course of trade.

  37. #2346060

Ar an dara dul síos, d’áitigh Rialtas na Síne go bhfuil ríomh an ghnáthluacha i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán ar neamhréir le ADA, go háirithe le hAirteagal 2.2. ADA lena soláthraítear liosta uileghabhálach de chásanna inar féidir an gnáthluach a ríomh, ach gan “saobhadh suntasach” a bheith liostaithe i measc na gcásanna sin.

Second, the GOC and CCCME argued that constructing the normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the ADA, in particular with Article 2.2. of the ADA which provides an exhaustive list of situations where the normal value can be constructed, the ‘significant distortions’ not being listed among such situations.

Commission Implementing Regulation (EU) 2022/558 of 6 April 2022 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of certain graphite electrode systems originating in the People’s Republic of China

  38. #2346121

Ar an dara dul síos, mheas CCCME go sáraíonn Airteagal 2(6a) den bhun-Rialachán Airteagal 2.2.1.1 den ADA agus an rialú in DS437 de bhrí faoi Airteagal 2(6a) den bhun-Rialachán, a luaithe a shuíonn an Coimisiún go bhfuil “saobhadh suntasach” ann, ní cheanglaítear ar an gCoimisiún dul tríd an dá choinníoll d’Airteagal 2.2.1.1 den ADA, eadhon an bhfuil na taifid i gcomhréir le GAAP na tíre onnmhairithe, agus an léiríonn na taifid go réasúnta na costais a bhaineann le táirgeadh agus díol an táirge faoi bhreithniú an táirge.

Second, the CCCME considered that Article 2(6a) of the basic Regulation violates Article 2.2.1.1 of the ADA and the ruling in DS437 because under Article 2(6a) of the basic Regulation, once the Commission establishes the existence of ‘significant distortions’, it is not required to go through the two conditions of Article 2.2.1.1 of the ADA, namely whether the records are in accordance with the GAAP of the exporting country, and whether the records reasonably reflect the costs associated with the production and sales of the product under consideration.

Commission Implementing Regulation (EU) 2022/558 of 6 April 2022 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of certain graphite electrode systems originating in the People’s Republic of China

  39. #2361020

Sa chéad dul síos, mhaígh CISA nach sainaithnítear i gComhaontú Frithdhumpála EDT (“ADA”) coincheap an tsaofa shuntasaigh in Airteagal 2.2 ADA, airteagal faoina gceadaítear ríomh an ghnáthluacha sa chás nach bhfuil aon díolachán i ngnáthchúrsa na trádála agus sa chás sin amháin.

First, CISA submitted that the WTO Anti-Dumping Agreement (‘ADA’) does not recognise the concept of significant distortions in Article 2.2 of ADA, which only allows the construction of the normal value if there are no sales in the ordinary course of trade.

  40. #2480200

A mhalairt ar fad, dírítear san athbhreithniú sin ar chinneadh a dhéanamh maidir le corrlach dumpála chun a áirithiú gur féidir le leibhéal na ndleachtanna deireadh a chur le héifeachtaí na dumpála díobhálaí go leordhóthanach agus, dá bhrí sin, tá údar leis an athbhreithniú faoi Airteagal 11.1 agus Airteagal 11.2 de ADA, agus tá sé i gcomhréir iomlán le rialacha infheidhme ADA lena n-áirítear Airteagal 2.

On the contrary, such review focuses on the dumping margin determination to ensure that the level of duties can adequately eliminate the effects of injurious dumping and is therefore warranted under Articles 11.1 and 11.2 of the ADA, and in full conformity with the applicable ADA rules including Article 2.

Commission Implementing Regulation (EU) 2022/1233 of 18 July 2022 amending Implementing Regulation (EU) 2020/492 imposing definitive anti-dumping duties on imports of certain woven and/or stitched glass fibre fabrics originating in the People’s Republic of China and Egypt

  41. #2503600

Dá réir sin, measann an Coimisiún go bhfuil Airteagal 2(6a) den bhun-Rialachán go hiomlán i gcomhréir le rialacha ábhartha ADA, lena n-áirítear na féidearthachtaí an gnáthluach a ríomh dá bhforáiltear in Airteagal 2.2 de ADA.

Consequently, the Commission considers Article 2(6a) of the basic Regulation to be fully compliant with the relevant rules of the ADA, including the possibilities to construct normal value provided in Article 2.2 of the ADA.

Commission Implementing Regulation (EU) 2022/1394 of 11 August 2022 imposing a definitive anti-dumping duty on imports of silicon originating in the People’s Republic of China, as extended to imports of silicon consigned from the Republic of Korea and from Taiwan, whether declared as originating in the Republic of Korea or Taiwan or not, following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and the Council

  42. #2560400

Ar an gcéad dul síos, rinne Rialtas na Síne, chomh maith le CISA an argóint go bhfuil sé ar neamhréir leis an gComhaontú Frithdhumpála (“ADA”) de chuid EDT an gnáthluach a thógáil i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán, go háirithe le hAirteagal 2.2 den ADA lena soláthraítear liosta iomlán de chásanna inar féidir leis an ngnáthluach a thógáil, gan an “saobhadh suntasach” a bheith liostaithe i measc cásanna den sórt sin.

First, the GOC, as well as CISA, argued that constructing the normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the WTO Anti-Dumping Agreement (‘ADA’), in particular with Article 2.2. of the ADA which provides an exhaustive list of situations where the normal value can be constructed, the ‘significant distortions’ not being listed among such situations.

Commission Implementing Regulation (EU) 2022/2247 of 15 November 2022 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of electrolytic chromium coated steel products originating in the People’s Republic of China and Brazil

  43. #2560559

Mhaígh Rialtas na Brasaíle, faoin ADA, gurb iad praghsanna na n-allmhairí dumpáilte agus an táirge comhchosúil sa Bhallstát is allmhaireoir ina n-iomláine na bunpharaiméadair chun scrúdú a dhéanamh maidir le sladghearradh agus nach raibh aon bhunús le mír 1 ná mír 2 d’Airteagal 3 den ADA ná le haon fhoráil eile sa Chomhaontú maidir le cosc ar allmhairí ó chuideachtaí nach ndéantar de thairgeoirí/onnmhaireoirí samplacha iad, ós rud é go meastar iad a bheith dumpáilte.

The GOB claimed that under the ADA, the basic parameters for carrying out an undercutting test are the prices of the dumped imports and the like product in the importing Member as a whole and that there is no basis in paragraphs 1 and 2 of Article 3 of the ADA nor in any other provision in the Agreement for excluding imports from companies not composing the producers/exporters sample, since they are considered to be dumped.

Commission Implementing Regulation (EU) 2022/2247 of 15 November 2022 imposing a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of electrolytic chromium coated steel products originating in the People’s Republic of China and Brazil

  44. #2703427

Go deimhin, baineann Airteagal 5(4) de Chomhaontú Frithdhumpála EDT leis an tsaincheist maidir le seasamh agus ní thugtar aghaidh ann ar an gceist ar leithligh maidir le cad is mórchion ann faoi Airteagal 4(1) de Chomhaontú Frithdhumpála EDT.

Indeed, Article 5(4) of the WTO ADA concerns the issue of standing and does not address the separate question of what constitutes a major proportion under Article 4(1) of the WTO ADA.

  45. #2717116

Mhaígh na páirtithe sin freisin nárbh fhéidir céatadán den sórt sin a mheas mar chion ollmhór den tionscal intíre de réir Airteagal 4 den Chomhaontú maidir le Cur Chun Feidhme Airteagal VI den Chomhaontú Ginearálta um Tharaifí agus Trádáil 1994 (“EDT ADA”), agus go raibh amhras ann go ndearna táirgeoirí intíre an gearán nó go ndearnadh an gearán ar a son, ar táirgeoirí iad a chomhlíon an tairseach 25 % a bhí leagtha síos in Airteagal 5(4) de EDT ADA.

These parties also claimed that such percentage could not be considered a major proportion of the domestic industry according to Article 4 of the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 (‘WTO ADA’), and that it was doubtful that the complaint was made by or on behalf of domestic producers fulfilling the 25 % threshold set in Article 5(4) of WTO ADA.

  46. #2745565

Ar dhóigh níos sonraí, maidir leis an gcéad argóint, mhaígh na páirtithe nach n-aithnítear le Comhaontú Frithdhumpála EDT (“ADA”) coincheap an tsaofa shuntasaigh in Airteagal 2.2 ADA, airteagal faoina gceadaítear ríomh an ghnáthluacha i gcás nach bhfuil aon díolachán i ngnáthchúrsa na trádála nó i gcás staid áirithe sa mhargadh agus sna cásanna sin amháin.

More specifically, concerning the first argument, the parties took the position that WTO Anti-Dumping Agreement (‘ADA’) does not recognise the concept of significant distortions in Article 2.2 of ADA, which only allows the construction of the normal value if there are no sales in the ordinary course of trade or in the case of a particular market situation.

Commission Implementing Regulation (EU) 2023/809 of 13 April 2023 imposing a definitive anti-dumping duty on imports of certain stainless steel tube and pipe butt-welding fittings, whether or not finished, originating in the People’s Republic of China and Taiwan following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council

  47. #2856397

Ar an dara dul síos, d’áitigh Rialtas na Síne go bhfuil ríomh an ghnáthluacha i gcomhréir le hAirteagal 2(6a) den bhun-Rialachán ar neamhréir leis an gComhaontú Frithdhumpála (‘ADA’), go háirithe le hAirteagal 2.2. de ADA lena soláthraítear liosta uileghabhálach de chásanna inar féidir an gnáthluach a ríomh, ach gan ‘saobhadh suntasach’ a bheith liostaithe i measc na gcásanna sin.

Second, the GOC argued that constructing the normal value in accordance with Article 2(6a) of the basic Regulation is inconsistent with the Anti-Dumping Agreement (‘ADA’), in particular with Article 2.2. of the ADA which provides an exhaustive list of situations where the normal value can be constructed, the “significant distortions” not being listed among such situations.

  48. #2969234

Thairis sin, fiú dá mba rud é go dtiocfadh coincheap an tsaofa shuntasaigh faoi Airteagal 2.2 den Chomhaontú Frithdhumpála, nach amhlaidh an cás de réir CCCMC, ba ghá ríomh an Aontais ar an ngnáthluach ríofa a bheith i gcomhréir le hAirteagal 2.2.1.1 den Chomhaontú Frithdhumpála agus leis an léirmhíniú atá ag an mBuanchomhlacht Achomhairc air freisin, rud a sholáthraítear sa chás AE – Bithdhíosal (An Airgintín) (DS473).

Moreover, even if the concept of significant distortions would fall under Article 2.2 ADA, which is not the case in CCCMC’s view, the EU’s calculation of the constructed normal value would also need to be in conformity with Article 2.2.1.1 of the ADA and with the Appellate Body’s interpretation thereof, provided in the EU – Biodiesel (Argentina) (DS473) case.

  49. #2970086

Ní hamhlaidh an cás de réir CCCMC, ós rud é go gceadaítear leis an modheolaíocht de bhun Airteagal 2(6a) den bhun-Rialachán go ríomhfaí an gnáthluach tar éis saobhadh suntasach a aimsiú, seachas i gcomhréir leis na coincheapa dá ndéantar foráil in Airteagal 2.2 den Chomhaontú Frithdhumpála.. Thairis sin, mhaígh CCCMC nach bhfuil aon airteagal sa Chomhaontú Frithdhumpála lena gceadaítear, chun an gnáthluach a chinneadh, go n-úsáidfí sonraí ó thríú tír nach léiríonn go hiomchuí an leibhéal praghsanna nó costais sa tír thionscnaimh.

This is not the case in CCCMC’s view, since the methodology pursuant to 2(6a) of the basic Regulation allows the construction of the normal value upon finding significant distortions rather than in line with the concepts foreseen by Article 2.2 ADA. Moreover, CCCMC submitted that there is no article in the ADA allowing use, for the purposes of determining the normal value, of data from a third country which does not appropriately reflect the prices or cost level in the country of origin.

  50. #3000058

Chun tacú lena mhaíomh, thug an táirgeoir onnmhairiúcháin na hargóintí céanna agus a thug CCCMC/GMIA, go sonrach nach n-aithnítear in Airteagal 2.2 de ADA EDT an coincheap maidir le saobhadh suntasach, agus nach bhfuil aon airteagal in ADA lena gceadaítear sonraí ó thríú tír nach féidir a léiriú go bhfuil praghsanna nó leibhéal costais na tíre is onnmhaireoir le húsáid chun an gnáthluach a chinneadh.

In support of its claim the exporting producer provided the same arguments as CCCMC/GMIA, notably that Article 2.2 of the WTO ADA does not recognise the concept of significant distortions, and that there is no provision in the ADA allowing data from a third country which cannot reflect the prices or cost level of the exporting country to be used for determining the normal value.
