    Comment A marriage is voidable on the ground that the marriage has not been consummated owing to the incapacity of either party to consummate it. A party is incapable of consummating a marriage if his or her mental health or physical condition makes consumation a practical impossibility. The condition must be one which existed at the time of the marriage. The test of consummation is penetration.
