- Comment Prior checking (Article 27) is no longer required following the repeal of Regulation (EC) No 45/2001 by Regulation (EU) 2018/1725. The new procedure is called "prior consultation" [ IATE:836814 ]. While the criteria for prior checking under the old Regulation and prior consultation under the new Regulation are not identical, there is a certain overlap – most processing operations requiring a data protection impact assessment under the Regulation already required prior checking under the old Regulation. There are also processing operations that required prior checking under the old Regulation, but which will not require a data protection impact assessment.

- Comment Le contrôle préalable prévu par l'article 27 du règlement (CE) n° 45/2001 n'est plus requis depuis l'abrogation de ce règlement par le règlement (UE) 2018/1725. La nouvelle procédure est celle de la consultation préalable [IATE:836814]. Les critères qui entraînaient respectivement un contrôle préalable en application de l'ancien règlement et une consultation préalable en application du nouveau règlement ne sont pas identiques, bien qu'ils se recouvrent dans une certaine mesure. Le règlement (UE) 2018/1725 a notamment ajouté l'étape de l'analyse d’impact relative à la protection des données [IATE:3541754].
