    Comment Discretionary leave to remain is only granted if the case falls within limited categories. It is granted outside the UKBA Immigration Rules and must not be granted if the person qualifies for asylum, Humanitarian Protection or any other category under the Immigration Rules. Persons granted discretionary leave are entitled to public benefits and may work. Situations where DL may be granted: - medical cases: these have a very high threshold. The individual must essentially be dying in order not to be sent back. - exceptional circumstances: where an individual has exhausted all submission rights available to him, in accordance with Paragraph 353B of the Immigration Rules, the decision-maker may nonetheless decide that there are exceptional circumstances which make it no longer appropriate that the individual be removed from the UK. The decision-maker will consider the individual's a) character and conduct, including whether there is a criminal record; b) compliance with conditions of previous grants of leave to enter or remain and c) length of time spent in the UK spent for reasons beyond the migrant's control after the claim has been submitted or refused. - other cases where return would breach Article 8 of the ECHR (unreasonable and disproportionate interference by UK authorities with the individual's private and family life).
