    Comment 'Exceptional leave to remain was granted pre 01/04/03 in some cases where asylum had been refused. Two types of leave, Humanitarian Protection (HP) and Discretionary Leave (DL) have since replaced this.' (UK Home Office) However, 'exceptional leave to remain' is also used, more generally, in the EU context (see fourth Term 1 reference - list of residence permits) as an equivalent for the German term 'Duldung', which can be more accurately described as 'a temporary suspension of deportation' ('vorübergehende Aussetzung der Abschiebung').

    Definition To be granted asylum under the 1951 UN Refugees Convention it is necessary to demonstrate a well founded fear of persecution because of race, religion, nationality, membership of a particular social group or political opinion. Alternatively, asylum seekers can be granted 'exceptional leave to remain', a discretionary grant of leave made by the Home Secretary, allowing a person to stay in the UK for a limited period of time.
