    Comment 1. The term 'treaty shopping' may at times appear to be used synonymously with 'tax treaty abuse', but treaty shopping is in fact a specific form of treaty abuse and is therefore a narrower term.2. In the EU, Action 6 of the OECD BEPS report is followed up by the Commission, as part of the anti-tax-avoidance package, through its Recommendation on the implementation of measures against tax treaty abuse (21.6.2019). That Recommendation belongs to the first pillar of the package, which aims to ensure effective taxation in the EU.

    Comment - Cette utilisation abusive peut être le fait des parties contractantes à la convention (un État) ou de personnes physiques ou morales.- Ne pas confondre avec le chalandage fiscal qui est un type d'utilisation des conventions fiscales.Au sein de l'UE, la Commission européenne assure le suivi de l'Action 6 du rapport BEPS de l'OCDE dans le cadre du paquet de mesures contre l’évasion fiscale, comme elle le prévoit dans sa Recommandation concernant la mise en œuvre de mesures contre l'utilisation abusive des conventions fiscales. Cette recommandation fait partie du premier volet du paquet, qui vise à lutter de manière efficace contre les pratiques fiscales agressives mises en œuvre par les grandes entreprises.
