    The Convention on Facilitation of International Maritime Traffic (‘the FAL Convention’) provides that public authorities must in all cases require only essential reporting information and keep the number of items to a minimum.

    Táthar ag súil go nglacfaidh Coiste Éascaíochta IMO leasuithe ar an Iarscríbhinn a ghabhann leis an gCoinbhinsiún maidir le hÉascú Muirthrácht Idirnáisiúnta (“Coinbhinsiún FAL”) ag an 46ú seisiún dá chuid (“FAL 46”) ón 9 go dtí an 13 Bealtaine 2022.

    The Facilitation Committee of the IMO, during its 46th session (‘FAL 46’) from 9 to 13 May 2022, is expected to adopt amendments to the Annex to the Convention on Facilitation of International Maritime Traffic (‘FAL Convention’).

    Is iomchuí an seasamh atá le glacadh thar ceann an Aontais le linn an 46ú seisiún den Choiste Éascaíochta a bhunú, toisc go bhféadfadh na leasuithe atá beartaithe ar an Iarscríbhinn a ghabhann le Coinbhinsiún FAL tionchar cinntitheach a imirt ar inneachar dhlí an Aontais, eadhon Treoir 2010/65/AE ó Pharlaimint na hEorpa agus ón gComhairle agus, ón 15 Lúnasa 2025, Rialachán (AE) 2019/1239 ó Pharlaimint na hEorpa agus ón gComhairle.

    It is appropriate to establish the position to be adopted on the Union’s behalf during the 46th session of the Facilitation Committee, since the envisaged amendments to the Annex to the FAL Convention are capable of decisively influencing the content of Union law, namely Directive 2010/65/EU of the European Parliament and of the Council and, as from 15 August 2025, Regulation (EU) 2019/1239 of the European Parliament and of the Council.

    Leis na leasuithe ar an Iarscríbhinn a ghabhann le Coinbhinsiún FAL, thabharfaí an Iarscríbhinn sin níos gaire do cheanglais Rialachán (AE) 2019/1239 agus do na rialacha comhaontaithe gnó maidir leis an Rialachán sin a chur chun feidhme, eadhon tríd an tarchur leictreonach trí ionad ilfhreastail a dhéanamh éigeantach, athrá eilimintí sonraí a chosc, cosc a chur ar úsáid foirmeacha páipéir le haghaidh tarchur sonraí, agus an ceanglas maidir le síniú de láimh a tharscaoileadh.

    The amendments to the Annex to the FAL Convention would bring that Annex closer to the requirements of Regulation (EU) 2019/1239 and the agreed business rules for implementing that Regulation, namely by making electronic transmission through a single window mandatory, preventing data elements from being repeated, preventing paper forms from being used for the transmission of information, and waiving the requirement for manual signatures.

    "By way of derogation from Articles 4 and 7, Member States may authorise seamen holding a seafarer's identity document issued in accordance with the International Labour Organization (ILO) Seafarers' Identity Documents Convention No 108 (1958) or No 185 (2003), the Convention on Facilitation of International Maritime Traffic (FAL Convention) and the relevant national law, to enter the territory of the Member States by going ashore to stay in the area of the port where their ships call or in the adjacent municipalities, or exit the territory of the Member States by returning to their ships, without presenting themselves at a border crossing point, on condition that they appear on the crew list, which has previously been submitted for checking by the competent authorities, of the ship to which they belong.
