- Definition appearance of the whole or a part of a product resulting from the features, in particular, the lines, contours, colours and shape, of the texture, of the materials of the product itself and/or its decoration, including the movement, transition or any other sort of animation of those features which complies with the conditions contained in Regulation (EC) No 6/2002 and is thus protected throughout the EU in registered or unregistered form Reference COM-Terminology Coordination and COM-EN, based on: COM-Internal documents: GROW-2022-80248-00-01 (Proposal for a Regulation amending Council Regulation (EC) No 6/2002 on Community designs and repealing Commission Regulation (EC) No 2246/2002) and GROW-2022-80252-00-01 (Proposal for a Directive on the legal protection of designs)
- Comment 1) Directive 98/71/EC and Regulation (EC) No 6/2002 define design more narrowly as ‘appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colours, shape, texture and/or materials of the product itself and/or its ornamentation’.2) 'Animation' is an umbrella term (used in particular in the context of graphic user interfaces (GUIs)), including inter alia the design and transition of moving images. An example of 'movement' would be the way a phone is opened and closed, whereby not only the appearance of the closed and opened state are features of the design, but also how it goes from one to the other state. An example of 'transition' would be LED lighting that changes colour, or any product including such lighting, whereby the sequence of the colour change is a feature.
