- Definition Als Ehewohnung ist jede Räumlichkeit anzusehen, die während der Ehe beiden Ehegatten gemeinsam als Unterkunft dient bzw. gedient hat oder die dafür nach den Umständen bestimmt war. - Comment An der Ehewohnung besteht berechtigter Mitbesitz beider Ehegatten, gleichgültig, wer von ihnen Eigentümer oder Mieter ist. Das Recht zum Mitbesitz besteht solange, bis ein Ehegatte im Einverständnis mit dem anderen zum Zwecke des Getrenntlebens die Wohnung verlässt oder bis der Familienrichter die Wohnung einem Ehegatten zur alleinigen Benutzung zuweist.
