Comment 'The right to property is a traditional fundamental right in democratic and liberal societies. It is contained in all national constitutions and has been established by the case law of the Court of Justice. Article 17(1) of the EU Charter sets out the conditions governing this right, which are also applicable to intellectual property. The right to property is protected by an additional protocol to the European Convention on Human Rights (Article 1), and only the limitations for which it provides are admissible. (See EP website, explanatory notes on the EU Charter of Fundamental Rights: http://www.europarl.europa.eu/comparl/libe/elsj/charter/art17/default_en.htm )

Definition right allowing the owner (creator as artist or inventor) or any rightsholder of copyrighted works or industrial property such as patents, trademarks, designs, models, brands or designations of origin to benefit from their own work or investment in a creation and decide how, when and where their creations are used and/or exploited Reference Council-EN based on:- 'What is Intellectual Property?' World Intellectual Property Organization (WIPO) http://www.wipo.int/edocs/pubdocs/en/intproperty/450/wipo_pub_450.pdf [6.12.2017]- EUR-Lex Glossary of Summaries http://eur-lex.europa.eu/summary/glossary/intellectual_property.html [6.12.2017]
Comment On its TRIPS (6.11.2021) page, the WTO defines intellectual property rights simply as 'the rights given to people over the creations of their minds'.The holder thus has monopoly power on the use of the item, normally for a specified period of time and within a specific geographic area. This power allows the holder of an intellectual property right to restrict imitation and duplication of the product concerned. IPRs prevent free riding by other companies and constitute an incentive to undertake R & D efforts.
