- Comment N'existe pas dans les systèmes de common law. Dans les systèmes de droit civil, il existe de grandes différences quant à la substance des pactes successoraux autorisés, et même certains systèmes les interdisent totalement ou partiellement.Aux fins de la Convention de La Haye de 1989 sur la loi applicable à cause de mort, les pactes successoraux sont inclus dans les "dispositions à cause de mort" (IATE:890905 ), tout comme les testaments (IATE:1130370 ), mais à l'inverse des dispositions entre vifs (IATE:3528547 ).
