Kapitalabfindung: de; Comment Unter den im BGB geregelten Voraussetzungen schuldet ein Ehegatte auch nach der Scheidung dem anderen Ehegatten Unterhalt (z.B. weil der andere Ehegatte ein gemeinsames Kind erzieht). Der Unterhalt ist grundsätzlich in Form einer monatlichen Geldrente zu zahlen. Eine Abfindung des Unterhaltsanspruchs durch eine einmalige Zahlung ist nur ausnahmsweise unter den Voraussetzungen des § 1585 BGB vorgesehen. / Sous les conditions prévues au Code civil allemand, une obligation alimentaire d'un époux à l'égard de l'autre subsiste même aprés le divorce (p.e. lorsque l'autre époux a la garde d'un enfant commun). L'obligation alimentaire doit être acquittée, en principe, sous forme d'une rente en argent mensuelle. Une prestation compensatoire unique n'est prévue que dans les cas exceptionnels prévus au § 1585 du Code civil allemand.

provision of compensation: en; Comment Compensation is one of the criteria which guide the courts in England & Wales as to redistribution of matrimonial assets. Lord Nicholls in Miller v Miller: 'compensation… is aimed at redressing any significant prospective economic disparity between the parties arising from the way they conducted their marriage. For instance, the parties may have arranged their affairs in a way which has greatly advantaged the husband in terms of his earning capacity but left the wife severely handicapped so far as her own earning capacity is concerned. Then the wife suffers a double loss: a diminution in her earning capacity and the loss of a share in her husband's enhanced income. … Although less marked than in the past, women may still suffer a disproportionate financial loss on the breakdown of a marriage because of their traditional role as home-maker and child-carer'. It may be achieved (balanced against other criteria) by one of the orders specified in the Matrimonial Causes Act 1973 rather than by a specific 'prestation compensatoire'.
