    Comment Während das italienische Mediationsverfahren nach dem Decreto legislativo Nr. 28/2010 vorsieht, dass der Mediator einen Einigungsvorschlag unterbreitet, wenn die Parteien nicht zu einer einvernehmlichen Einigung kommen, ist ein solcher Schritt im Rahmen eines Mediationsverfahrens nach dem deutschen Mediationsgesetz nicht möglich. Wie aus den Kontexten hervorgeht, kommen die Begriffe „Eingigungsvorschlag“ und „Vorschlag zur Streitbeilegung“ insofern nur in Verbindung mit Schieds- und Schlichtungsverfahren vor, während die Begriffe „Einigung“ und „Streitbeilegung“ auf alle Verfahren der außergerichtlichen Streitbeilegung anwendbar sind.
