Sainmhíniú (in an inquisitorial legal system) magistrate appointed to investigate cases (by gathering evidence, questioning witnesses, etc.) and decide whether or not they should be brought to trial Tagairt ‘examining magistrate’ (8.6.2020), Lexico.com, Oxford University Press, 2019
Nóta This concept is specific to certain civil law countries and has no direct equivalent in (typically English-speaking) common law countries. The English terms on this entry are therefore approximations.Examining magistrates have an important role in the French judiciary: the public prosecutor refers the most complex criminal cases (felonies and misdemeanours) to them. They are also a feature of the Spanish, Dutch, Belgian, Greek and Slovenian criminal justice systems. In Portugal, they preside over the optional preliminary judicial stage of a criminal investigation for determining whether there are sufficient grounds for taking a person accused of a crime to trial.
