- Definition Adultery. An act of voluntary sexual intercourse which takes place during the subsistence of a valid marriage with a person of the opposite sex who is not the spouse. It is a ground for a decree of judicial seperation but may not be relied upon solely by an applicant for a decree, where the spouses have lived with each other for more than a year after the adultery became known to the applicant; the court may also refuse a decree where the respondent proves that the adultery was committed with the connivance of the applicant. - Comment In Deutschland wurde Ehebruch bis 1969 stafrechtlich sanktioniert und stellte bis zur Reform des Scheidungsrechts 1976 einen eigenständigen Scheidungsgrund dar (§ 42 EheG). Das derzeitige deutsche Recht kennt den Begriff des Ehebruchs in dieser Form nicht mehr; allerdings können außereheliche Beziehungen eine Verwirkung des Unterhaltsanspruchs zur Folge haben und ein Indiz für das eine Scheidung rechtfertigende Scheitern einer Ehe sein.

- Comment Il s'agit d'une violation du devoir de fidélité, constitue, aux conditions de l’article 242 code civil, une faute cause de divorce ou de séparation de corps et peut engager la responsabilité civile (mais non plus pénale) de son auteur. Longtemps demeuré une cause péremptoire de divorce, l’adultère était aussi un délit pénalement sanctionné. Après avoir perdu cette spécificité avec la loi du 11 juillet 1975 relative au divorce, l’adultère n’en reste pas moins sanctionné.
