    Comment Wie aus § 153d StPO ( https://www.gesetze-im-internet.de/stpo/__153d.html ) hervorgeht, bezeichnet der Begriff "Staatsschutzdelikt" die in § 74a ( https://www.gesetze-im-internet.de/gvg/__74a.html ) und § 120 GVG ( https://www.gesetze-im-internet.de/gvg/__120.html ) aufgeführten Straftaten. Diese decken sich weitgehend mit den Delikten, die nach französischem Recht als "atteinte aux intérêts fondamentaux de la nation" angesehen werden (Verrat, Spionage usw.). Alternativ kommt auch eine etwas weniger spezifische Umschreibung der oben angegebenen Art in Betracht. . Der Begriff der "schweren staatsgefährdenden Gewalttat" gemäß § 89a StGB ( http://www.gesetze-im-internet.de/stgb/__89a.html ) geht zwar in dieselbe Richtung, hat aber nach der gesetzlichen Definition einen engeren Anwendungsbereich. Er ist zudem etwas irreführend, da die darunter fallenden Straftaten nicht unbedingt die Anwendung von Gewalt im üblichen strafrechtlichen Sinne voraussetzen.
