    Comment Nach § 1360 BGB sind "[d]ie Ehegatten ... einander verpflichtet, durch ihre Arbeit und mit ihrem Vermögen die Familie angemessen zu unterhalten. Ist einem Ehegatten die Haushaltsführung überlassen, so erfüllt er seine Verpflichtung, durch Arbeit zum Unterhalt der Familie beizutragen, in der Regel durch die Führung des Haushalts." Obgleich die Verpflichtung aus § 1360 BGB, die ein Zusammenleben der Ehegatten voraussetzt, eine Unterhaltsverpflichtung ist, ist sie - im Gegensatz zu anderen Unterhaltspflichten - nicht in Form einer Geldrente, sondern in Natur und ggf. durch die Gewährung von Haushalts- und Taschengeld an den anderen Ehegatten zu leisten. Der Familienunterhalt umfasst ferner nicht nur den sich aus dem ehelichen Haushalt ergebenden Bedarf des jeweils anderen Ehegatten, sondern auch den Bedarf der gemeinsamen Kinder, den der berechtigte Ehegatte im eigenen Namen von dem verpflichteten Ehegatten geltend machen kann. / Aux termes du § 1360 du Code civil allemand "[l]es époux sont mutuellement obligés de contribuer de manière adéquate, par leur travail et par leur patrimoine, aux charges de la famille. Lorsqu'un des époux est responsable pour le ménage, il s'acquitte de son obligation de contribuer par son travail aux charges de la famille, en règle générale, par la tenue du ménage." Bien que l'obligation resultant du § 1360 précité, qui suppose la cohabitation des époux, soit une obligation alimentaire, celle-ci ne consiste pas - contrairement aux autres obligations alimentaires - dans le versement d'un rente en espèce, mais dans des prestations en nature et, le cas échéant, d'argent du ménage et/ou de poche à l'autre époux. Les charges de la famille comprennent d'ailleurs non seulement les besoins de chacun des époux resultant de la communauté de vie entre eux, mais également les besoins des enfants communs que l'époux créancier peut réclamer en son propre nom de l'époux débiteur.

    Comment La contribution aux charges du mariage dépasse le simple devoir de secours. Cette contribution correspond en fait au train de vie fixé par les époux et comprend donc les dépenses courantes et nécessaires ainsi que les dépenses élevées et exceptionnelles. Sont ainsi compris dans cette contribution les dépenses de nourriture, de logement, d'habillement, de santé mais également les dépenses d'agrément telles que l'acquisition d'une résidence secondaire (Civ.1ère, 20 mai 1981, N° 79-17.171: La contribution des époux aux charges du mariage est distincte, par son fondement et par son but, de l'obligation alimentaire et peut inclure des dépenses d'agrément.)
