Sainmhíniú (1) Any individual to whom maintenance is owed or is alleged to be owed. [UE] // (2) A person to whom a court has ordered that money be paid periodically by another person (the debtor). [UK] Tagairt (1) Council Regulation (EC) No 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations, Article 1(9). // (2) Magistrates' Courts Act 1980 Section 59, Office of Public Sector Information (OPSI) http://www.opsi.gov.uk/RevisedStatutes/Acts/ukpga/1980/cukpga_19800043_en_8#pt2-pb5-l1g81 [22.02.2010]
Nóta The term 'maintenance creditor' is used in the regulation 32009R0004 with that meaning in UK in relation to jurisdiction and rarely otherwise. The term 'creditor' is used in the Magistrates' Courts Act 1980 to describe a person to whom a court has ordered that money be paid periodically by another person (the debtor). Without court intervention a child is not owed money by his parents ie he is not a creditor in sense (2) but if his parents separate he can be a maintenance creditor in sense (1) who is owed maintenance by the non-resident parent.
