    right in rem
    en
Definition a right involving or determining the status of a thing (the res), exercisable against the world at large and not just the parties to the litigation concerned Reference Council-EN based on Gillhams - Law Firm, Legal Terms http://www.gillhams.com/dictionary/508.cfm and the Oxford Dictionary of Law, 5th Edition, Elizabeth A. Martin, Oxford University Press, 2003
Comment As opposed to a right in personam [ IATE:905619 ], which is a right against a specific natural or legal person (e.g. a party to litigation).A right in rem need not relate to a tangible res. Thus a right that one's reputation should not be unjustifiably attacked is today described as a right in rem, since it is a right that avails against persons generally. [Black's Law Dictionary quoting G.W. Paton & David P. Derham eds., 4th edition, 1972] The right to liberty of action, as long as it does not interfere with other persons' rights, is also a right in rem [Jowitt's Dictionary of English Law, 2nd Edition, John Burke, Sweet & Maxwell, 1977]. A right of usufruct, for instance, which does not exist in UK law, is also a right in rem.[Council-EN]Most EU Member States have closed lists of rights in rem. [Council-EN]
