Proving that the estranged spouses have lived apart from one another for a period or periods amounting to at least four years during the previous five years provides the basis for a court granting a divorce decree (Section 5, Family Law (Divorce) Act 1995). Neither spouse is required to prove that the other is to blame for or has caused the spouses to live apart. Neither does it matter that the spuse initiating divorce proceedings is in fact to blame for the couple's marriage breaking down or is in desertion of the other spouse. Proof of 'fault' is of no relevance to the granting of a decree of divorce. However, misconduct by a spouse during the course of the marriage may affect the type of orders the court ultimately determines should be made by way of ancillary relief.     Comment Das deutsche Recht kennt seit dem 01.07.1977 keine Scheidung wegen Verschuldens mehr. Einziger Scheidungsgrund ist seither das Scheitern der Ehe (§ 1565 BGB, http://www.gesetze-im-internet.de/bgb/__1565.html ), wobei es insoweit nicht darauf ankommt, ob ein Ehegatte das Scheitern verschuldet hat. / En droit allemand, il n'existe, depuis le 01/07/1977, plus de divorce pour faute. Le seul motif pour un divorce est désormais le fait que le mariage a échoué (§ 1565 du Code civil allemand, http://www.gesetze-im-internet.de/bgb/__1565.html ), sans qu'il importe si cet échec est imputable à un époux.

    Comment Parmi les fautes suceptibles d'entraîner un divorce, on peut citer l'adultère, même si le divorce ne sera pas nécéssairement, dans ce cas, prononcé aux torts exclusifs du conjoint fautif. Dans tous les cas, c'est le Juge qui appréciera au vue du dossier qui est réellement fautif; l'abandon du domicile conjugal, puisque la loi considère que les époux se doivent une communauté de vie. Comme pour l'adultère, le Juge émet un jugement au cas par cas qui dépend de l'intensité de la faute et de l'ensemble du dossier; la non-contribution aux charges du mariage, chaque conjoint devant y contribuer "à hauteur de ses revenus". S'il ne le fait pas, cette attitude peut lui être reprochée. Ici encore le Juge émet un jugement basé sur la condition des deux époux ainsi que sur les dossiers qu'ils auront établis chacun; un comportement répréhensible, ce dernier cas concernant tout ce qui peut être reproché aux comportements du conjoint.
