    Comment Die Aufhebung der häuslichen Gemeinschaft ist ein Tatbestandsmerkmal des Getrenntlebens im Sinne von § 1567 BGB in seiner heutigen Fassung, das wiederum nach § 1566 BGB eine Vermutung für das Scheitern der Ehe begründet, welches wiederum der einzige Scheidungsgrund nach geltendem deutschen Recht ist. § 1567 BGB in seiner bis zum 31.12.1937 geltenden Fassung hingegen regelte die "böswillige Verlassung", die ein eigenständiger Scheidungsgrund war und neben dem Verlassen des Ehegatten auch eine böswillige Absicht des Verlassenden voraussetzte. / La cessation de la vie commune ("Aufhebung der häuslichen Gemeinschaft") est un élément constitutif de la séparation de fait au sens de l'actuel § 1567 du Code civil allemand, laquelle pour sa part fonde la présomption que le mariage est échoué, l'echec du mariage étant le seul motif de divorce selon le droit allemand en vigeur. Le § 1567 du Code civil allemand dans sa version applicable jusqu'au 31/12/1937 prévoit l'abandon du foyer conjugal comme motif autonome de divorce, l'abandon du foyer conjugal présupposant outre l'abandon du conjoint une mauvaise intention de l'auteur de l'abandon.

    Comment En dehors de toute autorisation de résidence séparée, les époux peuvent vivre séparément que la décision soit commune ou bien imposée par la volonté unilatérale de l’un des époux qui quitte par exemple le logement conjugal. La situation de fait qui en résulte ne saurait en principe être juridiquement admise. En tout état de cause, la violation de l’obligation de communauté de vie demeure une cause potentielle de divorce pour faute prononcé aux torts de celui qui a rompu cette communauté de vie. Il y a toutefois des nuances: le juge appréciera si l’abandon du foyer conjugal est ou non à l’origine de la séparation. Il s’agit désormais d’appréciation au cas par cas et il n’est plus possible de déclarer fautive, in astracto, toute rupture de la communauté de vie.
