Mais le terme est parfois utilisé dans un sens générique incluant la contrefaçon. L'expression quasi-pléonastique "piratage des droits d'auteur" ramène au sens strict, excluant la contrefaçon.- D'après le règlement (UE) n° 608/2013, le piratage porte atteinte aux droits d'auteur ou droits voisins ainsi qu'aux droits liés aux dessins et modèles, alors que dans le cadre de l'accord sur les ADPIC le piratage ne porte atteinte qu'aux droits d'auteur ou droits voisins.Si le piratage est pratiqué dans un but commercial, on peut préciser et parler de piraterie commerciale.
