    Nóta Die Staaten sind nach internationalem Recht verpflichtet, den Zugang zur Justiz sicherzustellen. Der Zugang von Frauen zur Justiz ist zwar ein gesetzlicher und verfassungsrechtlicher Rahmen, der Frauenrechte garantiert, jedoch sind Frauen ohne Bildung, Kenntnis der eigenen Rechte und Entscheidungsmacht oftmals nicht in der Lage, ihre Rechte geltend zu machen, Prozesskostenhilfe zu erlangen oder vor Gericht zu ziehen. Im Verfahrenskontext bedeutet Zugang zur Justiz, dafür zu sorgen, dass diejenigen, die ihre erworbenen Rechte sichern wollen, über zweckdienliche und verständliche Informationen zum Umfang ihrer Rechte und Zugang zu diesen Rechten über eine – in formalem wie praktischem Sinne – leicht zugängliche Infrastruktur für die Inanspruchnahme dieser Informationen und anschließend entsprechendes Tätigwerden, deren Qualität ihrer Funktionsweise in der Praxis gewährleistet ist, verfügen und Vertrauen in die Brauchbarkeit und Integrität der Infrastruktur haben können. Um sekundäre Viktimisierung und Stigmatisierung von Frauen im Verlauf von Gerichtsverfahren zu vermeiden, ist ein geschlechtersensibler Ansatz erforderlich. Schwerpunkt eines materiellrechtlichen Aspekts der Justiz ist es sicherzustellen, dass rechtliche und gerichtliche Ergebnisse selbst auch angemessen und gerecht sind.

    Nóta States have obligations under international law to ensure access to justice. Women’s access to justice is a legal and constitutional framework that guarantees women’s rights, but without education, awareness of rights and decision-making power, women are often unable to claim their rights, obtain legal aid or go to court. In a procedural sense, access to justice means providing those seeking to secure their vested rights with the following: appropriate and understandable information about the scope of these rights and how to access them; a readily accessible infrastructure − in both the formal and practical sense − for acquiring this information and then acting upon it; the quality of the functioning of this infrastructure in practice; and the confidence in the utility and integrity of the infrastructure. To avoid secondary victimisation and stigmatisation of women during legal proceedings, a gender-sensitive approach is required. A substantive aspect of justice focuses on ensuring that legal and judicial outcomes are themselves ‘just and equitable’.

Un aspect important de la justice est axé sur l'assurance de constats légaux et décisions judiciaires «justes et équitables».
