Conversely, once a non-EU producer can show that they have already paid a price for the carbon used in the production of the imported goods in a third country, the corresponding cost can be fully deducted for the EU importer. The CBAM will help reduce the risk of carbon leakage by encouraging producers in non-EU countries to green their production processes.The scheme has been designed in compliance with World Trade Organization (WTO) rules and other international obligations of the EU, and complements the EU’s emissions trading system (ETS).

- Nóta Il s'agit d'assurer une concurrence équitable entre les produits importés de pays ne taxant pas ou pas assez les émissions de CO2 et ceux produits dans l'UE et soumis à une telle taxation.Selon la proposition du Parlement européen de 2019, pourrait être une ressource propre de l'UE.Le mécanisme est conçu dans le respect des obligations internationales de l'UE et des règles de l'OMC et vient compléter le système d'échange de quotas d'émission de l'UE.Il repose sur le principe suivant: les importateurs de biens produits en dehors de l'UE achètent des certificats carbone correspondant au prix du carbone qui aurait êté payé si les marchandises importées avaient été produites conformément aux règles de l'UE en matière de tarification du carbone. Dès lors qu'un producteur d'un pays tiers peut démontrer qu'il a déjà payé un prix pour le carbone utilisé dans la production des marchandises importées, le prix correspondant peut être déduit pour l'importateur de l'UE.
