    Nóta Der Begriff "schwere Körperverletzung", der nach deutschem Recht einen spezifischen und besonders schwerwiegenden Straftatbestand bezeichnet ( Verbrechen, IATE:3585133 ), wird zuweilen auch vom Unionsgesetzgeber verwendet. Inwieweit Deckungsgleichheit besteht, lässt sich nicht mit Bestimmtheit sagen. . Charakteristisch für den deutschen Tatbestand ist jedenfalls, dass die Körperverletzung nicht nur schwerwiegend, sondern auch dauerhaft sein muss.

Le code pénal prévoit une gradation des peines en fonction des circonstances, de la nature et des conséquences des blessures causées. Ainsi, l’article 398 qui incrimine les blessures ou les coups prévoit une aggravation de la peine encourue en cas de préméditation. L’article 399 prévoit une peine plus grave «si les coups ou les blessures ont causé une maladie ou une incapacité de travail personnel», la peine étant encore aggravée, aux termes de l’article 400, «s'il est résulté des coups ou des blessures, soit une maladie paraissant incurable, soit une incapacité de travail personnel de plus de quatre mois, soit la perte de l'usage absolu d'un organe, soit une mutilation grave», etc. Système juridique françaisLa notion "coups et blessures graves" n'existe pas en droit pénal français. Le terme "coups et blessures" – pourtant employé dans le code de procédure pénale en ce qui concerne l'exécution d'un mandat d'arrêt européen – a disparu du code pénal français en 1981. Dans le système juridique français on parle plutôt de "violences" dont la sanction est qualifiée dans le code pénal selon la gravité des blessures occasionnées ; tandis que les violences ayant entraîné une incapacité totale de travail pendant plus de huit jours (art. 222-11 (14.7.2021)) et les violences ayant entraîné une mutilation ou une infirmité permanente (art. 222-9 (14.7.2021)) sont qualifiées comme un délit, les violences ayant entraîné la mort sans intention de la donner (art. 222-7 (14.7.2021)) sont qualifiées comme un crime.
