The law has not changed yet and in The Children and Family Relationships Bill, a draft piece of legislation that should change the law in this area the terms “guardianship”, “custody” and “access” have been retained because these are used in a Constitutional amendment on this subject but the definitions are those proposed in the Law Reform Commission report. At the moment, when Irish case law or literature refers to “contact rights” it is usually a reference to the concept in the Hague convention.
