    Comment To put it another way, following the passing of the relevant prescriptive period, the person owing the obligation or having the liability (the debtor), is no longer bound by that obligation or accordingly liable, as the relevant obligation has been extinguished. The corollary is that the person holding the right to which that obligation relates (the creditor) can no longer enforce that right, as it has ceased to exist.
