- Nóta Text as originally adopted on 28 May 2001 / Consolidated version of 4 December 2008. The 2001 regulation is due to be replaced by Regulation (EU) 2020/1783 on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters (taking of evidence) (recast) on 1 July 2022, apart from a few provisions (see Article 35 of the 2020 Regulation).NB: The taking of evidence includes the examination of a person (e.g. hearing of a witness) and the inspection of documents or objects (e.g. visiting the scene of an occurrence). The procedure can only be used for judicial proceedings in civil or commercial matters which have either commenced or are being contemplated.
