Nóta The implementation of MiFID I resulted in different approaches to the application and interpretation of the inducements regime. MiFID II addresses these issues by preventing investment firms providing independent advice or portfolio management from accepting and retaining fees, commissions or any monetary or non-monetary benefits other than, under certain conditions, minor non-monetary benefits. In all other cases, investment firms are allowed to receive an inducement provided that disclosure is provided and that the inducement is designed to enhance the quality of the relevant service to the client and it does not impair compliance with the investment firm’s duty to act honestly, fairly and professionally in accordance with the best interest of its clients.
