    Nóta Voir aussi: brevet [IATE:1615107 ] Un brevet essentiel à une norme est un brevet dont l’exploitation est indispensable à tout concurrent envisageant de fabriquer des produits conformes à la norme à laquelle il est lié. En d’autres termes, il est impossible de fabriquer un produit conforme à la norme sans entrer dans la portée du brevet dit « essentiel » à cette norme.L’organisme de normalisation est dans le cas présent l’ETSI (European Telecommunication Standards Institute), chargé de créer des normes et de veiller à ce que l’argent investi dans la préparation et l’adoption de ces normes ne soit pas perdu par la non disponibilité de leur propriété industrielle. A cet effet, il cherche à trouver un équilibre entre la normalisation des technologies, aux fins de l’usage public, et le respect des droits des titulaires de titres de propriété intellectuelle. Lorsqu’un brevet lui est notifié, a priori par son titulaire, l’ETSI permet à ce brevet d’acquérir un caractère essentiel [IATE:3575120 ]. À partir de ce moment, personne ne peut donc commercialiser de produit conforme à ladite norme sans être potentiellement contrefacteur de ce brevet. En échange de l’obtention du caractère essentiel à la norme, le titulaire du brevet s’engage à octroyer des licences d’exploitation de ce brevet à des conditions dites « FRAND » (fair, reasonable, and non-discriminatory, soit «équitables, raisonnables et non discriminatoires»). Si le titulaire du brevet refuse d’accorder des licences à des conditions «FRAND», les travaux d’adoption de la norme sont arrêtés par l’ETSI. Il s’agit donc d’un accord donnant-donnant.
