Comment See also:- racketeering [ IATE:1129325 ]- racketeering and extortion [ IATE:52320 ]The current term in UK law for this concept is blackmail [ IATE:891681 ]; "extortion" ceased to be an offence in the UK in 1968 under the Theft Act. Prior to 1968, "extortion" was a narrowly defined concept: according to Jowitt's Dictionary of English Law, the offence of "extortion by colour or office or franchise" was "any oppression under colour of right, as the demanding of more than a legal fee by colour of office; the misdemeanour committed by a public officer, who, under colour of his office, wrongfully takes from any person any money or valuable thing. It was punishable at common law by fine and imprisonment, and removal from office".

Definition Crime of obtaining money or any other advantage by threats. [UK_SCT] Reference Sir Gerald H. Gordon, "Criminal Law", 3rd Edition by Michael G.A. Christie, Volume II, W.Green & Son Ltd, Edinburgh, 2001, ISBN 0 414 013999, p.247.
Comment The term "racketeering" is not synonymous with "extortion" and is thus not equivalent to the French term "racket" (false friends). Under US law, racketeering is a very broad concept which encompasses a wide range of criminal activities usually committed as part of organised crime. According to the US "Racketeer Influenced and Corrupt Organizations Statute", racketeering activity means "any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, dealing in obscene matter, or dealing in a controlled substance or listed chemical…, which is chargeable under State law and punishable by imprisonment for more than one year…" It also includes certain offences of counterfeiting, fraud, misuse of passport, trafficking in persons, etc. See http://www.law.cornell.edu/uscode/usc_sec_18_00001961----000-.html
