    Comment On its TRIPS (6.11.2021) page, the WTO defines intellectual property rights simply as 'the rights given to people over the creations of their minds'.The holder thus has monopoly power on the use of the item, normally for a specified period of time and within a specific geographic area. This power allows the holder of an intellectual property right to restrict imitation and duplication of the product concerned. IPRs prevent free riding by other companies and constitute an incentive to undertake R & D efforts.

Le monopole a des coûts sociaux, qui peuvent toutefois être compensés par l’affectation des recettes ainsi générées à la promotion de niveaux plus élevés de créativité. La propriété intellectuelle couvre les œuvres littéraires et artistiques (protégées par les droits d’auteur), les inventions (protégées par brevets), les signes distinctifs des produits d’une entreprise (protégés par marque déposée) et d’autres éléments relevant de la propriété industrielle.
