Sainmhíniú correction factor applied by the Commission to bring the amount of free emission allowances [ IATE:3534203 ] allocated provisionally by Member States to certain energy producers over a specified period of time into line with the maximum amount of free allowances determined separately by the Commission1 for that same period Tagairt Council-CENTERM, based on: - Court of Justice press release No 47/16, Luxembourg, 28 April 2016, http://curia.europa.eu/jcms/upload/docs/application/pdf/2016-04/cp160047en.pdf [20.12.2016] - Commission Staff Working Document accompanying the proposal for a Directive amending Directive 2003/87/EC to enhance cost-effective emission reductions and low-carbon investments, http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A52015SC0135 - Opinion of Advocate General Kokott on a number of joined cases concerning the validity of the method for calculating the uniform cross-sectoral correction factor - CELEX:62014CC0191/EN
Nóta 1. The method used by the Commission1 is based on Commission Decision of 27 April 2011 determining transitional Union-wide rules for harmonised free allocation of emission allowances pursuant to Article 10a of Directive 2003/87/EC, CELEX:32011D0278/EN 2. The 'correction factor' has been controversial since it applies equally to all installations regardless of their energy efficiency and has tended to reduce the overall number of free allowances. The Commission's calculation method has also differed from that of the Member States. 3. For more details, see the above reference documents.
