Sauf cas de licenciement pour faute grave ou lourde, le salarié recevra une indemnité compensatrice de préavis qui est calculée sur le base de la rémunération qu'il aurait normalement perçue s'il avait travaillé pendant son préavis. Le salarié peut aussi lui-même demander une dispense de préavis. L'employeur est alors libre d'accepter ou de refuser. S'il accepte, le contrat de travail prendra fin à la date convenue entre les parties. Mais comme la demande de dispense émane cette fois-ci du salarié, ce dernier n'aura pas droit à une indemnité compensatrice de préavis.
