(5) I gcás a bhfaighfear airgead ar iasacht faoin alt seo féadfaidh an t-iasachtaí nó na hiontaobhaithe a bheidh ainmnithe faoi fho-alt (3) a chur de mhuirear ar an talamh go léir a chuimsítear sa tsocraíocht go n-aisíocfar leis an gCorparáid an t-airgead a gheofar ar iasacht amhlaidh agus an t-ús air, agus beidh éifeacht leis an muirear sin mar dhiúscairt faoi na Settled Land Acts, 1882 to 1890, agus, i gcás arb amhlaidh do na himthosca gur mhuirear tosaíochta an muirear sin dá mba faoi alt 39 (1) nó 42 (1) a dhéanfaí é, beidh an muirear sin ina mhuirear tosaíochta agus ina mhuirear buanfheabhsaithe agus bainfidh Caibidil 2 nó 3 (de réir mar is gá sa chás) den Chuid seo leis an muirear sin dá réir sin.
(5) Where money is borrowed under this section the borrower or the trustees nominated under subsection (3) may charge all the land comprised in the settlement with the repayment to the Corporation of the money so borrowed and the interest thereon and such charge shall have effect as a disposition under the Settled Land Acts, 1882 to 1890, and, where the circumstances are such that such charge, if made under section 39 (1) or 42 (1), would be a priority charge, such charge shall be a priority charge and a permanent improvement charge and Chapter 2 or 3 (as the case may require) of this Part shall apply to such charge accordingly.
