    Accordingly, the Convention is compatible with existing international instruments, in particular the 2000 United Nations Convention against Transnational Organized Crime and its protocols, the 2003 United Nations Convention against Corruption, the 2001 Council of Europe Budapest Convention on Cybercrime and its protocols, but also other relevant international and regional instruments, in particular relating to the protection of human rights and fundamental freedoms.

    This Regulation is without prejudice to Union and national legal acts providing for the sharing of, access to and the use of data for the purpose of the prevention, investigation, detection or prosecution of criminal offences or for the execution of criminal penalties, or for customs and taxation purposes, irrespective of the legal basis under the Treaty on the Functioning of the European Union (TFEU) on which such Union legal acts were adopted, as well as to international cooperation in that area, in particular on the basis of the Council of Europe Convention on Cybercrime, (ETS No 185), done at Budapest on 23 November 2001.

I gcás aistrithe idir soláthraithe seirbhíse agus údaráis faoin bPrótacal, níl feidhm ag an Scáth-Chomhaontú ach amháin in éineacht le socrú sonrach breise de réir bhrí Airteagal 3, mír 1, den Scáth-Chomhaontú lena dtugtar aghaidh ar na riachtanais uathúla a bhaineann le fianaise leictreonach a bheith á haistriú go díreach ag soláthraithe seirbhíse seachas idir údaráis. For transfers between service providers and authorities under the Protocol, the Umbrella Agreement applies only in combination with a further, specific agreement within the meaning of Article 3, paragraph 1, of the Umbrella Agreement that addresses the unique requirements of the transfer of electronic evidence directly by service providers rather than between authorities. In the absence of such a specific transfer agreement, such transfers may take place under the Protocol, in which case, Article 14, paragraph 1.a, in conjunction with Article 14, paragraphs 2 to 15, of the Protocol apply.’.

    Therein, the Council recalled that several aspects of the negotiations on a comprehensive international convention on countering the use of information and communications technologies for criminal purposes could relate to the Common Foreign and Security Policy, by stressing that it ‘supports and promotes the Budapest Convention on Cybercrime and the ongoing work on the Second Additional Protocol to this Convention. Furthermore, it continues to engage in multilateral exchanges on cybercrime, including in processes related to the Council of Europe, the United Nations Office on Drugs and Crime (UNODC) and the Commission on Crime Prevention and Criminal Justice (CCPCJ), to ensure an enhanced international cooperation to counter cybercrime, including the exchange of best practices and technical knowledge and support for capacity building, while respecting, promoting and protecting human rights and fundamental freedoms’.
