    Member States have declared, as parties to the Joint Procurement Agreement referred to in Article 5 of Decision No 1082/2013/EU of the European Parliament and of the Council, their agreement to the inclusion of ongoing joint procurement procedures under that Article in the fast-track procurement procedure established by this Regulation, under the conditions set out therein. The type of medical countermeasures to be procured and the distribution of the countermeasures to Member States should follow any agreement reached under those ongoing procedures.

    EEA States that are signatories to the Joint Procurement Agreement to procure medical countermeasures may agree that their participation in EU-managed procurements of medical countermeasures will be subject as relevant to the rules and conditions set out in this Regulation. As those derogations are introduced as a consequence of the current COVID‐19 crisis, they should be temporary and apply for the same period as that of the activation of the emergency support under this Regulation.

    Subject to any applicable Union or national public procurement rules, including those concerning the avoidance of conflicts of interest and maintaining confidentiality, it should be possible to grant Member States not participating in the joint action to procure the common auction platform observer status in whole or in part in the joint procurement process upon terms and conditions agreed between the Member States participating in the joint action and the Commission in the joint procurement agreement.

    The terms and conditions of the joint procurement agreement referred to in Article 26(5), first subparagraph, or the contract appointing an auction platform pursuant to Article 26(1) may derogate from paragraph 1 of this Article by requiring Member States that have notified the Commission pursuant to Article 29(3) of their decision not to participate in the joint action as provided in Article 26(1), but subsequently make use of the common auction platform, to pay to the auction platform concerned, including the clearing systems or settlement systems connected to it, the costs of the services provided for in Article 27(1) related to the volume of allowances which that Member State auctions from the date when that Member State commences auctioning through the common auction platform until the termination or expiry of the term of appointment of that auction platform.
