I bhfeidhmiú na gcumhachtaí a thugtar dom le halt 1 den Acht Talmhan, 1923 (Uimh. 42 de 1923) (arna leasú le halt 3 d'Acht na mBannaí Talmhan, 1925 (Uimh. 25 de 1(25), le halt 6 den Acht Talmhan, 1931 (Uimh. 11 de 1931), le halt 6 den Acht Talmhan, 1936 (Uimh. 41 de 1936) agus le halt 9 den Acht Talmhan, 1939 (Uimh. 26 de 1939)), le halt 4 d'Acht na mBannaí Talmhan, 1933 (Uimh. 33 de 1933) agus le halt 7 d'Acht na mBannaí Talmhan, 1934 (Uimh. 11 de 1934), déanaimse, EOGHAN MAC GEARAILT, Aire Airgeadais, leis seo na Rialacháin seo a leanas:
I, GENE FITZGERALD, Minister for Finance, in exercise of the powers conferred on me by Section 1 of the Land Act, 1923 (No. 42 of 1923) (as amended by Section 3 of the Land Bond Act, 1925 (No. 25 of 1925), Section 3 of the Land Act, 1931 (No. 11 of 1931), section 6 of the Land Act, 1936 (No. 41 of 1936), and section 9 of the Land Act, 1939 (No. 26 of 1939), section 4 of the Land Bond Act, 1933 (No. 33 of 1933), and section 7 of the Land Bond Act, 1934 (No. 11 of 1934), hereby make the following regulations:

—(1) Déanfar an t-airgead ceannaigh go léir (seachas airgead ceannaigh is gá, do réir Achta na mBannaí Talmhan, 1933 ( Uimh. 33 de 1933 ), d'íoc tré bhannaí nua talmhan do thabhairt amach fén Acht san agus seachas airgead ceannaigh a roimh-íocfar ar shlí eile seachas tré bhannaí talmhan ar n-a dtabhairt amach fé Acht do ritheadh roimh an Acht so), a bheidh iníoctha ag Coimisiún na Talmhan tar éis an Achta so do rith le díoltóirí, d'íoc tré bhannaí talmhan, ar n-a mbunú fén Acht so agus is có-ionann in ainm-mhéid leis an airgead ceannaigh sin, do thabhairt amach fén Acht so.
—(1) All purchase money (except purchase money which is required by the Land Bond Act, 1933 (No. 33 of 1933), to be paid by means of an issue of new land bonds under that Act and except purchase money which is advanced otherwise than by means of land bonds issued under an Act passed before this Act) payable by the Land Commission after the passing of this Act to vendors shall be paid by means of an issue under this Act of land bonds created under this Act equal in nominal amount to such purchase money.

—(1) Gach roimh-íoc (seachas roimh-íocanna is gá, do réir Achta na mBannaí Talmhan, 1933 ( Uimh. 33 de 1933 ), do dhéanamh tré bhannaí nua talmhan do thabhairt amach fén Acht san) a dhéanfaidh Coimisiún na Talmhan chun crícheanna an Phríomh-Achta, tar éis an Achta so do rith, is tré bhannaí talmhan ar n-a mbunú fén Acht so do thabhairt amach fén Acht so a déanfar é.
—(1) All advances (except advances which are required by the Land Bond Act, 1933 (No. 33 of 1933), to be made by means of an issue of new land bonds under that Act) made for the purposes of The Principal Act by the Land Commission after the passing of this Act shall be made by means of an issue under this Act of land bonds created under this Act.

(3) Nuair a bheidh an ráta úis a bheidh ar aon tsreath de bhannaí talmhan á cheapadh ag an Aire Airgid fén alt so, féachfaidh do sna praghsanna ar a mbeidh an Iasacht Náisiúnta is déanaí bheidh tugtha amach agus bannaí talmhan a bheith tugtha amach roimhe sin fén Acht so no fé Acht na mBannaí Talmhan, 1933 (Uimh. 33 de 1933) , á luadh ar Bhúrsa Bhaile Atha Cliath, d'fhonn an ráta úis a ceapfar amhlaidh do bheith (laistigh de sna teoranta forchuirtear leis an alt so) de mhéid a chuirfidh in áirithe margadh-phraghas bannaí talmhan den tsreath san do bheith ar par no in aice par ar feadh ama réasúnta tar éis an tsreatha san do bhunú.
(3) When fixing under this section the rate of interest to be borne by any series of land bonds, the Minister for Finance shall have regard to the prices at which the latest issue of National Loan and previous issues of land bonds under this Act or the Land Bond Act, 1933 (No. 33 of 1933), are quoted on the Dublin Stock Exchange, to the intent that the rate of interest so fixed may (within the limits imposed by this section) be such as to secure that the market price of land bonds of the said series shall, for a reasonable time after the creation of the said series, be at or near par.

—(1) Féadfar, le rialacháin a dhéanfaidh an tAire Airgid fé Acht na mBannaí Talmhan, 1933 (Uimh. 33 de 1933) , chun crícheanna fo-ailt (4) d'alt 4 den Acht san agus le haon ordú no rialacháin a dhéanfaidh an tAire sin fé Acht na mBannaí Talmhan, 1934 (Uimh. 11 de 1934) , chun crícheanna fo-ailt (2) d'alt 7 den Acht san, socrú do dhéanamh i gcóir an dá ní seo leanas no i gcóir ceachtair acu, sé sin le rá:—
—(1) Regulations made by the Minister for Finance under the Land Bond Act, 1933 (No. 33 of 1933), for the purposes of sub-section (4) of section 4 of that Act, and any order or regulations made by the said Minister under the Land Bond Act, 1934 (No. 11 of 1934), for the purposes of sub-section (2) of section 7 of that Act may provide for both or either of the following things, that is to say:—

(5) Bainfidh Acht na mBannaí Talmhan, 1933 (Uimh. 33 de 1933) , no Acht na mBannaí Talmhan, 1934 (Uimh. 11 de 1934) , fé mar is gá sa chás, le bannaí talmhan ar n-a mbunú agus ar n-a dtabhairt amach ag an Aire Airgid chun cearta spóirt (seachas cearta iascaigh) do cheannach fé alt 34 den Acht Talmhan, 1933 , no fén alt so fé mar a bhaineann an tAcht san le bannaí talmhan ar n-a mbunú agus ar n-a dtabhairt amach ag an Aire sin chun crícheanna an Achta Talmhan, 1923 , no aon Achta de sna hAchtanna le n-a leasuítear no le n-a leathnuítear an tAcht san.
(5) The Land Bond Act, 1933 (No. 33 of 1933), or the Land Bond Act, 1934 (No. 11 of 1934), as the case may require, shall apply to land bonds created and issued by the Minister for Finance for the purchase of sporting rights (other than fishing rights) under section 34 of the Land Act, 1933 , or under this section in like manner as such Act applies to land bonds created and issued by the said Minister for the purposes of the Land Act, 1923 , or any of the Acts amending or extending that Act.

—Notwithstanding anything contained in section 5 of the Land Act, 1923 , section 7 of the Land Bond Act, 1933 (No. 33 of 1933), or section 8 of the Land Bond Act, 1934 (No. 11 of 1934), the following provisions shall have effect, that is to say:—

(a) ús a thiocfaidh o bhannaí talmhan a bheidh in aon cheann de sna cistí costaisí a bheidh bunuithe fé alt 5 den Acht Talmhan, 1923 , no fén alt san ar n-a chur i mbaint tré alt 7 d'Acht na mBannaí Talmhan, 1933 , no tré alt 8 d'Acht na mBannaí Talmhan, 1934 , agus fós airgead a bheidh íoctha isteach in aon chiste den tsórt san chun bannaí talmhan d'fhuascailt, féadfar o am go ham, sa mhéid ná beidh an céanna ag teastáil chun íocaíochtaí do dhéanamh in airgead fén alt so, é do shuncáil in aon bhannaí talmhan ar bith is cuma cad is sreath dhóibh;
( a ) interest accruing from land bonds in any of the costs funds established under section 5 of the Land Act, 1923 , or under that section as applied by section 7 of the Land Bond Act, 1933 , or by section 8 of the Land Bond Act, 1934 , and also moneys paid into any such fund in redemption of land bonds may from time to time, in so far as not required for the purpose of making payments in cash under this section, be invested in any land bonds whatsoever irrespective of their series;

(2) Na suimeanna uile cuirfear i leataoibh i gciste na mbannaí talmhan do réir ailt 5 d'Acht na mBannaí Talmhan, 1933 (Uimh. 33 de 1933) , no do réir orduithe ar n-a dhéanamh fé alt 4 d'Acht na mBannaí Talmhan, 1934 ( Uimh. 11 de 1934 ), agus ná beidh ag teastáil láithreach chun bannaí talmhan d'fhuascailt, féadfaidh an tAire Airgid, más oiriúnach leis é, iad do shuncáil i gceannach aon stuic, ciste, no urrúis go n-údaruítear d'iontaobhaithe le halt 18 den Acht um Oiriúnú Achtanna, 1922 ( Uimh. 2 de 1922 ), cistí iontaobhais do shuncáil ionta no i gceannach aon stuic, scaireanna, no urrúis go n-urruítear a gcolann agus an t-ús ortha fé údarás reachtúil ag Rialtas Shaorstáit Éireann, agus má deintear agus pé uair a déanfar aon tsuim a bheidh curtha i leataoibh amhlaidh do shuncáil amhlaidh beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(2) All sums set aside in the land bond fund in pursuance of section 5 of the Land Bond Act, 1933 (No. 33 of 1933), or of an order made under section 4 of the Land Bond Act, 1934 (No. 11 of 1934), and not immediately required for the redemption of land bonds may be invested by the Minister for Finance, if he so thinks fit, in the purchase of any stock, fund, or security in which trustees are authorised by section 18 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), to invest trust funds or in the purchase of any stock, shares, or security the principal of and interest on which are guaranteed under statutory authority by the Government of Saorstát Eireann, and if and whenever any sum so set aside is so invested the following provisions shall have effect, that is to say:—

—(1) Pé uair a déanfar, do réir ailt 14 den Acht Talmhan, 1923 , praghas fuascailte blianachta ceannaigh a bheidh ina muirear ar thalamh do thóg Coimisiún na Talmhan d'áireamh agus deighleáil leis mar éileamh i gcoinnibh airgid cheannaigh na talmhan san, déanfar (d'ainneoin éinní atá in alt 3 den Acht Talmhan, 1923 , mar a leasuítear san le halt 4 d'Acht na mBannaí Talmhan, 1925 ( Uimh. 25 de 1925 ), no san alt san 3 mar a leasuítear amhlaidh é agus mar a cuirtear i mbaint é tré alt 2 d'Acht na mBannaí Talmhan, 1933 ( Uimh. 33 de 1933 ), no tré alt 2 d'Acht na mBannaí Talmhan, 1934 ( Uimh. 11 de 1934 )) praghas fuascailte na blianachta ceannaigh sin d'íoc tré oiread de sna bannaí talmhan in aghaidh an airgid cheannaigh sin d'aistriú chun Coimisiún na Talmhan is leor do réir phraghais an lae chun praghas fuascailte na blianachta ceannaigh sin d'íoc.
—(1) Whenever the redemption price of a purchase annuity charged on land acquired by the Land Commission is, in pursuance of section 14 of the Land Act, 1923 , regarded and dealt with as a claim attaching to the purchase money of such land, the redemption price of such purchase annuity shall (notwithstanding anything contained in section 3 of the Land Act, 1923 , as amended by section 4 of the Land Bond Act, 1925 (No. 25 of 1925), or in the said section 3 as so amended and applied by either section 2 of the Land Bond Act, 1933 (No. 33 of 1933), or section 2 of the Land Bond Act, 1934 (No. 11 of 1934)) be paid by transferring to the Land Commission so much of the land bonds representing the said purchase money as shall be sufficient at the price of the day to pay the redemption price of such purchase annuity.

(b) pé uair a bheidh suim iníoctha le díoltóir fé fho-alt (2) d'alt 5 den Acht Talmhan, 1923 , no fén bhfo-alt san ar n-a chur i mbaint tré alt 7 d'Acht na mBannaí Talmhan, 1933 , no tré alt 8 d'Acht na mBannaí Talmhan, 1934 , féadfaidh an Coimisinéir Breithiúntais, más ceart san dar leis, a ordú go ndéanfar (fé mar a luadhfaidh an Coimisinéir Breithiúntais san ordú san) an tsuim sin ar fad no cuid áirithe dhi d'íoc in airgead, agus ar an ordú san do thabhairt amhlaidh, déanfar (fé mar is gá do réir an orduithe sin) an tsuim sin ar fad no an chuid áirithe sin di d'íoc in airgead agus, sa chás deiridh sin, íocfar an chuid eile den tsuim sin fé is dá mba ná hachtófaí an t-alt so;
( b ) whenever a sum is payable under sub-section (2) of section 5 of the Land Act, 1923 , or under that sub-section as applied by section 7 of the Land Bond Act, 1933 , or by section 8 of the Land Bond Act, 1934 , to a vendor, the Judicial Commissioner may, if he so thinks proper, direct that the said sum shall be paid either (as the Judicial Commissioner shall specify in such direction) wholly or to a specified extent in cash, and, upon such direction being so given, the said sum shall be paid either (as such direction requires) wholly or to the said specified extent in cash and, in the latter case, the residue of the said sum shall be paid as if this section had not been enacted;
