    —(1) There shall be established on such day as the Minister may by order appoint a body to be known as the Rent Tribunal (in this Act referred to as the Tribunal) to perform the functions assigned to it by this Act. [GA] (2) The Tribunal shall consist of the following members, namely, a chairman and so many vice-chairmen and ordinary members as the Minister, with the consent of the Minister for the Public Service, considers necessary from time to time for the performance by the Tribunal of its functions under this Act. [GA] ( 3 ) ( a ) The chairman, vice-chairmen and the ordinary members shall be appointed by the Minister by order. [GA] ( b ) The Minister may by order revoke or amend an order under paragraph (a) or this paragraph. [GA] ( c ) An order under this subsection shall be published in Iris Oifigiúil as soon as may be after it is made. [GA] (4) The Minister, with the consent of the Minister for the Public Service, may from time to time appoint from among his officers so many persons as he considers necessary to assist the Tribunal in the performance of its functions under this Act. [GA] Membership of Houses of Oireachtas, etc., by member of Tribunal. 3. —(1) A person who, for the time being, is entitled under the Standing Orders of either House of the Oireachtas to sit therein or is a representative in the Assembly of the European Communities or a member of a local authority shall be disqualified from being appointed to be a member of the Tribunal. [GA] (2) A member of the Tribunal who— [GA] ( a ) is nominated either as a member of Seanad Éireann or for election to either House of the Oireachtas, or [GA] ( b ) is either nominated for election to the Assembly of the European Communities or appointed to be a representative in that Assembly, or [GA] ( c ) becomes a member of a local authority, [GA] shall thereupon cease to be a member of the Tribunal. [GA] (3) In this section local authority" means the council of a county, the corporation of a county or other borough, the council of an urban district or the commissioners of a town. [GA] Seal of the Tribunal. 4. —(1) The Tribunal shall provide itself with a seal. [GA] (2) The seal of the Tribunal shall be authenticated by the signature of the chairman of the Tribunal or of a vice-chairman or ordinary member thereof authorised by the Tribunal to act in that behalf or a person appointed under section 2 (4) authorised by the Tribunal to act in that behalf. [GA] (3) Judicial notice shall be taken of the seal of the Tribunal, and every document purporting to be an instrument made by the Tribunal and to be sealed with the seal (purporting to be authenticated in accordance with this section) of the Tribunal shall be received in evidence and shall be deemed to be such instrument without further proof unless the contrary is shown. [GA] Fixing of terms of tenancies. 5. —(1) The landlord or the tenant of a dwelling to which section 8 (1) of the Act of 1982 relates may, subject to subsection (2), at any time— [GA] ( a ) apply to the Tribunal to fix the terms of the tenancy, or (Amendment) Act, 1963. ( f ) The Tribunal shall be the judge of its own competence except that, if an objection is raised before the Tribunal to the effect that the dispute falls within the jurisdiction of the Board or the Council under Article 56 or within the jurisdiction of a judicial or arbitral body designated in an agreement under Article 1 of this Annex and the Tribunal is satisfied that the objection is genuine, the objection shall be referred by the Tribunal to the Board or the Council or the designated body, as the case may be, and the arbitration proceedings shall be stayed until a decision has been reached on the matter, which shall be binding upon the Tribunal. ( g ) The Tribunal shall, in any dispute within the scope of this Annex, apply the provisions of this Convention, any relevant agreement between the parties to the dispute, the Agency's by-laws and regulations, the applicable rules of international law, the domestic law of the member concerned as well as the applicable provisions of the investment contract, if any. Without prejudice to the provisions of this Convention the Tribunal may decide a dispute ex aequo et bono if the Agency and the member concerned so agree. The Tribunal may not bring a finding of non liquet on the ground of silence or obscurity of the law. ( h ) The Tribunal shall afford a fair hearing to all the parties. All decisions of the Tribunal shall be taken by a majority vote and shall state the reasons on which they are based. The award of the Tribunal shall be in writing, and shall be signed by at least two arbitrators and a copy thereof shall be transmitted to each party. The award shall be final and binding upon the parties and shall not be subject to appeal, annulment or revision. ( i ) If any dispute shall arise between the parties as to the meaning or scope of an award, either party may, within sixty days after the award was rendered, request interpretation of the award by an application in writing to the President of the Tribunal which rendered the award.

    (4) When fixing the charges necessary to produce the standard revenue, the railway tribunal shall take into consideration the charges in respect of any business carried on by the company ancillary or subsidiary to its railways, the charges for which are not subject to the jurisdiction of the railway tribunal, and if, in the opinion of the railway tribunal, the company is not making, or has not taken reasonable steps to enable it to make adequate charges in respect of any such business, the railway tribunal shall, in fixing the charges under this Part, of this Act, take into account the revenue which would be produced by any such business if adequate charges were in operation.

    —(1) The Governor-General may, by order made on the advice of the Executive Council at any time while there are three standing members of the railway tribunal, declare that it is expedient in the public interest that on the expiration of the terms of office then current of the ordinary members of the railway tribunal no appointment of ordinary members of the railway tribunal should be made and that (without prejudice to the provisions of sub-section (4) of section 17 of the Principal Act) the railway tribunal should consist of the Chairman alone.

    (2) Whenever any person charged with an offence mentioned in the Appendix to this Article is (whether before or after this Article was inserted in this Constitution or before or after this section comes into force) remanded in custody or on bail by a Justice of the District Court or a Peace Commissioner, the Tribunal may, on the application of a member of the Gárda Síochána not below the rank of inspector, order that the trial of such person on such charge be transferred to the Tribunal, and thereupon such person shall be deemed to have been sent forward for trial by the Tribunal on the said charge at such time and place as the Tribunal shall direct.

    (2) The Board shall, on the request of any Arbitration Tribunal constituted as aforesaid, produce for inspection by the Tribunal such documents, books, records or accounts in the possession of the Board as are relevant to the matter at issue before the Tribunal, but no document, book, record or account shall be so produced if, in the opinion of the Minister as certified by him to the Tribunal, it would be injurious to the public interest so to do.
