Thairis sin, ní dochar an Treoir seo don chosaint a thugtar do thomhaltóirí arna ráthú le Treoir 2005/29/CE ó Pharlaimint na hEorpa agus ón gComhairle, lena dtoirmisctear cleachtais tráchtála éagóracha lena n-áirítear iad siúd a dhéantar le linn forfheidhmiú conartha i gcás ina gcuirtear tomhaltóir amú maidir le cearta nó oibleagáidí an tomhaltóra, nó ina ndéantar é a chiapadh, a chomhéigniú nó tionchar míchuí a imirt air lena n-áirítear ó thaobh uainiú, suíomh, nádúr nó comhsheasmhacht na ngníomhaíochtaí forfheidhmithe, ó thaobh úsáid teanga bagraí nó maslaí nó úsáid iompair bhagraigh nó mhaslaigh, nó ó thaobh bagairtí go ndéanfaí aon ghníomhaíocht nach féidir a dhéanamh go dlíthiúil.
Moreover, this Directive is without prejudice to the protection of consumers guaranteed by Directive 2005/29/EC of the European Parliament and of the Council, which prohibits unfair commercial practices including those carried out during the enforcement of a contract where a consumer is misled as to the consumer’s rights or obligations, or is subject to harassment, coercion or undue influence including in terms of the timing, location, nature or persistence of the enforcement actions, in terms of the use of threatening or abusive language or behaviour, or in terms of threats to take any action that cannot legally be taken.
