(4) Más rud é, in aon imeachtaí arna dtionscnamh in aghaidh iontaobhaí scéime mar gheall ar shárú iontaoibhe i ndáil le feidhm a thugtar dó nó di faoi fho-alt (3) a chomhlíonadh, gur dealraitheach don chúirt atá ag éisteacht an cháis go bhfuil an t-iontaobhaí, nó go bhféadfadh sé nó sí a bheith, faoi dhliteanas maidir leis an sárú iontaoibhe ach gur ghníomhaigh sé nó sí go hionraic agus go réasúnach agus gur chóir le ceart ag féachaint d’imthosca uile an cháis, an sárú iontaoibhe a mhaitheamh dó nó di, féadfaidh an chúirt faoiseamh iomlán nó páirteach a thabhairt dó nó di óna dhliteanas nó óna dliteanas ar cibé téarmaí is cuí leis an gcúirt.”.
(4) If, in any proceedings brought against a trustee of a scheme for breach of trust in relation to the performance by him or her of a function conferred under subsection (3), it appears to the court hearing the case that the trustee is or may be liable in respect of the breach of trust but that he or she acted honestly and reasonably and that having regard to all of the circumstances of the case he or she ought fairly to be excused for the breach of trust, the court may relieve him or her in whole or in part from his or her liability on such terms as the court deems appropriate.”.
