Where Union law on official controls already provides for specific official controls at border entities in accordance with Regulation (EC) No 882/2004 and Directives 91/496/EEC and 97/78/EC or at points of entry in accordance with Directive 2000/29/EC, for categories of goods referred to in paragraph 1 of this Article, Member States shall confer the responsibility of carrying out the controls referred to in paragraph 2 of this Article to the competent authorities tasked with those controls in accordance with Article 4 of Regulation (EC) No 882/2004 or with point (g) of Article 2(1) of Directive 2000/29/EC.

To preserve the effectiveness of official controls in the verification of compliance, no notice should be given prior to performing controls, unless such prior notice is absolutely necessary for the controls to be carried out (for example, in the case of those official controls performed in slaughterhouses during slaughter operations which require the continuous or regular presence of staff or representatives of the competent authorities in the operator’s premises) or the nature of the official control activities requires otherwise (as is particularly the case with regard to audit activities).

(21)Pursuant to and within the limits of Article 30 Ö 36 Õ of the Treaty Ö on the Functioning of the European Union Õ and pending a greater degree of harmonisation, Member States retain the right to carry out controls on transfers of certain dual-use items within the Community Ö Union Õ in order to safeguard public policy or public security. ð For reasons of proportionality, controls on the transfer of dual-use items within the Union should be revised in order to minimise the burden for companies and authorities. ï Where these controls are linked to the effectiveness of controls on exports from the Community, they ð Moreover, the list of items subject to intra-Union transfer controls in Section B of Annex IV ï should be periodically reviewed by the Council ð in light of technological and commercial developments and as regards the assessment of the sensitivity of transfers ï.
