‘qualified electronic registered delivery service’ means an electronic registered delivery service which meets the requirements laid down in Article 44;

Legal effect of an electronic registered delivery service
Maidir le sonraí a sheolfar agus a ghlacfar trí ríomhsheirbhís seachadta chláraithe a úsáid, ní shéanfar orthu éifeacht dhlíthiúil ná inghlacthacht mar fhianaise in imeachtaí dlíthiúla ar an bhforas amháin go bhfuil sé i bhfoirm leictreonaigh nó nach gcomhlíonann sé ceanglais uile na ríomhseirbhíse seachadta cláraithe.
Data sent and received using an electronic registered delivery service shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in an electronic form or that it does not meet the requirements of the qualified electronic registered delivery service.
Maidir le sonraí a sheolfar agus a ghlacfar trí ríomhsheirbhís seachadta chláraithe a úsáid, toimhdeofar sláine na sonraí sin, seoladh na sonraí sin ag an seoltóir sainaitheanta agus fáil na sonraí ag an seolaí sainaitheanta agus cruinneas an dáta agus an ama a sheolfar agus a gheofar na sonraí a shonróidh an ríomhsheirbhís seachadta cláraithe.
Data sent and received using a qualified electronic registered delivery service shall enjoy the presumption of the integrity of the data, the sending of that data by the identified sender, its receipt by the identified addressee and the accuracy of the date and time of sending and receipt indicated by the qualified electronic registered delivery service.

‘electronic registered delivery service’ means a service that makes it possible to transmit data between third parties by electronic means and provides evidence relating to the handling of the transmitted data, including proof of sending and receiving the data, and that protects transmitted data against the risk of loss, theft, damage or any unauthorised alterations;

Ní dhiúltóidh Páirtí éifeacht dhlíthiúil agus ceadmhacht ríomhdhoiciméad in imeachtaí dlíthiúla, ríomhshíniú, ríomshéala ná ríomhstampa ama ná sonraí a sheoltar agus a fhaightear agus úsáid a bhaint as ríomhsheirbhís seachadta cláraithe ar aon fhoras amháin gur i bhfoirm leictreonach atá sé.
A Party shall not deny the legal effect and admissibility as evidence in legal proceedings of an electronic document, an electronic signature, an electronic seal or an electronic time stamp, or of data sent and received using an electronic registered delivery service, solely on the ground that it is in electronic form.
