    I gcomhthéacs an dlí mhuirí ghinearálta, tagraíonn an coincheap ‘cuideachta loingseoireachta’ don eintiteas a gcuirtear de chúram air an soitheach a bhainistiú agus ní féidir é a mhodhnú le comhaontú déthaobhach idir na páirtithe.

    ciallaíonn “garda cósta” údaráis náisiúnta a dhéanann feidhmeanna garda cósta, lena gcuimsítear sábháilteacht mhuirí, slándáil mhuirí, custaim mhuirí, gáinneáil agus smuigleáil a chosc agus a dhíchur, forfheidhmiú cónasctha an dlí muirí, rialú teorann muirí, faireachas muirí, cosaint an chomhshaoil mhuirí, cuardach agus tarrtháil, freagairt timpiste agus tubaiste, rialú agus cigireacht iascach agus gníomhaíochtaí eile a bhaineann leis na feidhmeanna sin;

    Ina bhfianaise sin, is gá, chun críche EU ETS, imeacht ó bhrí an choincheap ‘cuideachta loingseoireachta’ sa dlí muirí ginearálta chun go mbeidh na páirtithe ábalta teacht ar chomhaontú conarthach eatarthu maidir le haitheantas an eintitis a gcuirtear na hoibleagáidí a leanann ó EU ETS de chúram air.

    In view of this fact, it is necessary to depart, for the purpose of the EU ETS, from the meaning of the notion of ‘shipping company’ in general maritime law in order to allow the parties to agree contractually among them on the identity of the entity that is entrusted with the obligations following from the EU ETS.

    Commission Implementing Regulation (EU) 2023/2599 of 22 November 2023 laying down rules for the application of Directive 2003/87/EC of the European Parliament and of the Council as regards the administration of shipping companies by administering authorities in respect of a shipping company

  21. #3037856

    A mhéid a imíonn an ceanglas sin ón gcleachtas maidir leis an sainmhíniú ar ‘cuideachta loingseoireachta’ sa dlí muirí ginearálta, tá sé teoranta do ghlacadh na freagrachta faoi EU ETS.

    To the extent this requirement deviates from the practice with regard to the definition of ‘shipping company’ in general maritime law, it is limited to the assumption of responsibility under the EU ETS.

    Commission Implementing Regulation (EU) 2023/2599 of 22 November 2023 laying down rules for the application of Directive 2003/87/EC of the European Parliament and of the Council as regards the administration of shipping companies by administering authorities in respect of a shipping company

  22. #3037855

    Chun forfheidhmiú cuí EU ETS a ráthú agus chun na difríochtaí idir EU ETS agus an dlí muirí ginearálta a chur san áireamh, ba cheart do na Ballstáit a áirithiú, i gcás eagraíocht nó duine a ghlac freagracht as oibriú na loinge ón longúinéir agus, an fhreagracht sin á glacadh aici nó aige, gur aontaigh sé na dualgais agus na freagrachtaí uile arna bhforchur leis an gCód Idirnáisiúnta um Bainistíocht Sábháilteachta, a leagtar amach in Iarscríbhinn I a ghabhann le Rialachán (CE) Uimh. 336/2006 ó Pharlaimint na hEorpa agus ón gComhairle a thógáil ar láimh, agus gur ghlac sé nó sí freisin an fhreagracht as oibleagáidí EU ETS, beidh an eagraíocht nó an duine sin sainordaithe go cuí ag an longúinéir cloí leis na bearta náisiúnta lena dtrasuítear Treoir 2003/87/CE, lena n-áirítear an oibleagáid liúntais a ghéilleadh faoi Airteagal 3gb agus Airteagal 12 den Treoir sin.

    To guarantee the proper enforcement of the EU ETS and to take account of the differences between the EU ETS and general maritime law, Member States should ensure that where the organisation or person that has assumed the responsibility for the operation of the ship from the shipowner and that, on assuming such responsibility, has agreed to take over all the duties and responsibilities imposed by the International Management Code for the Safe Operation of Ships and for Pollution Prevention, set out in Annex I to Regulation (EC) No 336/2006 of the European Parliament and of the Council has also assumed responsibility for the EU ETS obligations, such organisation or person has been duly mandated by the shipowner to comply with the national measures transposing Directive 2003/87/EC, including the obligation to surrender allowances under Articles 3gb and 12 of that Directive.

    Commission Implementing Regulation (EU) 2023/2599 of 22 November 2023 laying down rules for the application of Directive 2003/87/EC of the European Parliament and of the Council as regards the administration of shipping companies by administering authorities in respect of a shipping company
